Aaron Wainscoat concentrates his practice in patent litigation matters and complex business disputes involving high technology and other companies.

His intellectual property litigation experience includes all phases of discovery, claim construction briefing, pretrial and trial work and post-trial motions.

Mr. Wainscoat has experience managing patent and other cases and litigating matters in federal and state courts throughout the United States, including extensive experience before the International Trade Commission (ITC).

Recent Matters

  • Meltwater v. Alterian Rochester, Inc. et al. – Obtained a TRO, a preliminary injunction and, by settlement, a permanent injunction preserving client’s right to services and support.
  • Acer Incorporated v. Hewlett-Packard  ITC Inv. No. 337-TA-618. Represented Hewlett-Packard in a patent infringement action commenced by Acer Incorporated in the ITC. The asserted patents relate to chip package design and software for controlling an input device.
  • OPTi Inc. v. Silicon Storage Technology, Inc. et al. – United States District Court for the Eastern District of Texas. Represented Silicon Storage Technology, Inc., which was a defendant in a multi-defendant patent infringement lawsuit pertaining to two patents entitled "Compact ISA-bus Interface."
  • Hynix Semiconductor v. Toshiba Corporation – ITC Inv. No. 337-TA-553. Represented Toshiba in a patent infringement action commenced by Hynix Semiconductor in the ITC involving technology related to NAND flash memory products. In his initial determination, the ALJ found Toshiba did not violate section 337, Toshiba did not infringe either of the patents-in-suit, one of the patents was invalid, both patents were unenforceable due to inequitable conduct and Hynix failed to prove it has a domestic industry in either patent.
  • AuthenTec v. Hestia Technologies – United States District Court for the Middle District of Florida. Represented plaintiff manufacturer of biometric fingerprint sensors in IP dispute involving semiconductor packaging technology. Successfully obtained an exceptional case ruling and favorable settlement for client.
  • Zoran Corporation v. MediaTek, Inc. et al. – ITC Inv. Nos. 337-TA-506 and 337-TA-523. Represented Zoran Corporation and Oak Technology in suit and counter-suit against MediaTek, Inc. relating to optical disk controller chips. The cases settled on terms extremely favorable to Zoran and Oak following Exclusion Order and Cease and Desist Order against MediaTek.
