The legal system Legal system of Bosnia and Herzegovina (BiH) is premised on the Continental Europe legal system. It is necessary to explain briefly the legal organisation of BiH. BiH consists of two separate and distinct administrative entities: the Federation Bosnia and Herzegovina (FBiH) and the Republic of Srpska (RS), as well as the Brčko District BiH, which is an autonomous district. The entities and the Brčko District BiH have their own government and assemblies and enact their laws and regulations, which are typically harmonised, but yet separate and distinct.
Articles 4, 5 and 6 of the Constitution provides for four bodies of the Government; the Parliament, the Presidency, the Council of Ministers and the Constitutional Court. The Constitution of the BiH declares BiH is a democratic society operating on the principles of the Rule of Law and has free and democratic elections. The Council of Ministers is accountable to a legislature composed of elected members and representatives of three constitutional ethnicities, and to an independent judiciary that dispenses justice without bias. Human rights are preserved and protected in BiH.
The Constitution also provides for the legislative supremacy of the Parliament and the independence of the Judiciary. It embraces the principles of the Rule of Law, the separation of powers and a pluralistic political system.
