Courtney Stewart represents clients in a wide range of complex commercial litigation, with particular emphasis in the areas of securities and shareholder derivative litigation and general commercial disputes. Ms. Stewart has litigated matters at all levels from trial and post-judgment matters through appeal in federal and state courts.

Ms. Stewart has also advised clients in connection with regulatory and internal investigations.

Representative Matters

  • Representing publicly-traded medical device company in federal securities fraud class action following the company’s restatement of its financial statements. In re ArthroCare Corp. Securities Litigation, No. A-08-CV-574-SS (W.D. Tex.)
  • Represented senior officers and directors of public company in shareholder derivative cases alleging stock option backdating. Lee v. Baker, No. A-07-CV-009-SS (W.D. Tex.) (after successive motions to dismiss, plaintiffs voluntarily dismissed cases)
  • Represented manufacturing company in securities class action suit. Holzwasser v. Staktek Holdings, No. A-05-CV-239-LY (W.D. Tex.) (after withdrawal of original plaintiff, court denied motion to intervene of new plaintiff, dismissed case, and entered judgment for defendant)
  • Represented public company in distressed debt transaction under Texas contract law. First-chaired trial, which culminated in multi-million dollar verdict for client. Mesa Air Group v. APS Capital, No. A-07-CV-327-SS (W.D. Tex.)
  • Second-chaired trial to verdict in $20 million real estate development dispute involving breach of fiduciary duty and fraud claims. McBeth v. Carpenter, No. A-05-CV-359-LY (W.D. Tex.). Prepared brief on appeal, in which jury’s liability findings and actual damages were upheld. McBeth v. Carpenter, No. 07-51305 (5th Cir.)
  • Represented defendant navigation product manufacturer in patent infringement action involving GPS navigation and multimedia database technology. Encyclopaedia Britannica v. Alpine Electronics, No. A-05-CV-565-LY (W.D. Tex.) (won summary judgment). Prepared brief on appeal in which summary judgment was upheld. Encyclopaedia Britannica v. Alpine Electronics, No. 2009-1087 (Fed. Cir.)
  • Represented major insurer in federal lawsuits involving ERISA matters. Rodriquez v. Life Insurance Company of North America, No. A-08-CV-299-LY (W.D. Tex.) (won bench trial); Sanchez v. Life Insurance Company of North America, No. SA-08-CV-527-XR (W.D. Tex.) (won summary judgment, and prepared brief on appeal in which summary judgment was upheld (No. 09-51010 (5th Cir.)))
  • Representing for-profit education institution in Congressional and related investigations

Ms. Stewart serves on the firm-wide Pro Bono Committee and is a member of the firm's Associates Committee.
