Richard Fries is well known throughout the New York real estate community. He represents national and global institutional lenders, owners, and developers in the origination of commercial real estate loans, asset-based and structured finance, loan participations and syndications, joint ventures, distressed loan workouts and restructures, mortgage foreclosure, distressed portfolio and asset sales, property disposition, creditors’ rights, and insolvency.
Mr. Fries has been involved in the financing, foreclosure, and workout of permanent, construction and mezzanine loans, including agented and syndicated facilities (as well as joint venture interests), secured by hotels, office buildings, land development projects, health care complexes, apartment buildings, shopping centers, franchise operations, and automobile dealerships, among other real estate and business assets. He represents lending institutions in the purchase and sale of participation interests, performing and under-performing loan portfolios and real estate assets, and the implementation of national standard loan documentation for real estate and other loan products. He also represents investors in real estate joint ventures, and property owners, developers, and contractors in all aspects of commercial real estate litigation, construction litigation, conveyancing, asset disposition, development, and property management.
As a member of the Executive Committee of the Real Property Law Section of the New York State Bar Association, Mr. Fries has worked in conjunction with the New York Bankers Association in the drafting and passage of the amendment to Article 14 of the Real Property Actions and Proceedings Law to authorize the non-judicial foreclosure of commercial mortgages in New York.
In addition, over the past several years he has chaired and lectured at numerous PLI, state and city bar association continuing legal education programs on real estate finance, mortgage foreclosure and real estate workouts and remedies. He has written extensively on real estate and financing cases and on subjects of national and local interest.
In the 2008 edition of Chambers USA: America's Leading Lawyers for Business, the respected English research publisher Chambers & Partners names Mr. Fries as one of the country's leading real estate lawyers. Chambers notes that he is "a trusted adviser and expert negotiator who brings a wealth of experience and workable solutions to complex problems,” adding that "his expertise in distressed real estate assets and workouts is legendary, but he is equally adept at construction lending, franchising and general financing deals."
In 2008, Real Estate Weekly, the leading real estate newspaper for the New York metropolitan area, named Mr. Fries to its list of "All Stars in Real Estate." Only 22 lawyers in all were included on the list of New York's leading real estate professionals. Mr. Fries also is listed in The Best Lawyers in America in the area of real estate law, in the 2008 Guide to the World's Leading Real Estate Lawyers and in The Legal 500 United States in 2007 and 2008. He has been named a New York Super Lawyer in 2006 and 2007.
