IRAQI “TRANSITION PERIOD” DELAYS SOME LEGAL ACTIONS AGAINST CONTRACTORS

Just before Iraqi legal jurisdiction over US contractors was to take effect according to the terms of the recent Iraq-US Status of Forces Agreement, the Government of Iraq issued an order delaying implementation of certain Iraqi laws.

The order, issued December 31, 2008, establishes a “transition period” - effective immediately and continuing for an undefined length of time - during which the US and Iraq will establish procedures to facilitate full compliance with Iraqi law.

During this transition period, no law enforcement or other legal action will be taken against the United States or its contractors in the areas of licensing, registration, customs, duties, tariffs, inspections, and visas.

According to the GOI Order, all other Iraqi laws apply to contractors as of January 1, 2009.
