Frank Pepler is a partner in DLA Piper's Finance practice, based in San Francisco.

Mr Pepler represents banks, secured creditors and lessors in origination, restructuring and workout matters as well as in litigation. His experience also encompasses enforcement matters in federal district, federal bankruptcy and California state courts.

Mr. Pepler's matters include both real property and personal property secured transactions. A significant part of his work is matters governed by the Uniform Commercial Code, both in California and as adopted in other states, with a substantial practice advising secured creditors and securities intermediaries under Article 8 and Article 9.

Mr. Pepler has represented:

  • Major banks, insurance companies and leasing companies in loan origination matters.
  • One of the country's largest securities intermediaries in structuring new product lines and adapting procedures to permit the leveraging of securities held in trading accounts.
  • A significant private lender in a raw land development chapter 11 case pending in the Central District of California, and related litigation in state court and bankruptcy court, together with appeals to district court and the bankruptcy appellate panel.
  • Assignees for benefit of creditors in pending ABCs, together with related state court litigation.
  • A state court-appointed receiver in a mortgage company and three subsidiary cases and related litigation, and filing Chapter 7 cases on behalf of a receiver for each of four related companies.

Seminars

As an adjunct professor of law at the University of California, Hastings College of the Law from 1998 to 2002, Mr. Pepler structured and taught “Secured Transactions Under the Uniform Commercial Code.” The course emphasized the changes to secured transactions law that took effect July 1, 2001, the effective date of Revised Article 9 in California and in other adopting states.
