GETTING CLOSER? PATENT DIFFERENCES BETWEEN THE US AND THE EU, POST-PATENT REFORM

In September 2011, the America Invents Act was signed into law, concluding a multi-year drafting and negotiation process. Its effect is, among other things, to bring US patent law closer to the patent laws of other jurisdictions. Because the US is one of the most important patent filing jurisdictions, this law will impact both US and foreign inventors. At the same time European countries’ negotiations regarding the European Patent Package are nearing closure.

This panel discussion will consider the impact of the new law on companies doing business in both the US and Europe, with special focus on Germany, Europe’s largest economy and one of the most important trading partners of the US. Panelists will address topics including how the new US patent legislation differs from that of Europe, how such differences impact US and European businesses, and what new strategies are recommended in light of changes in patent law on both sides of the Atlantic.

SPEAKER BIOGRAPHIES

Timothy W. Lohse concentrates on patent prosecution, patent litigation and patent counseling. He provides patent preparation and prosecution in software and related technologies, including microprocessor branch prediction, computer cache memory replacement strategies, database storage systems and database architectures, wireless applications, wireless content development systems, content searching algorithms and systems, automatic coupon generation and brand preference determination systems, written and auditory content development systems and other web-based business systems.

Julia Schoenbohm, a partner in DLA Piper’s Intellectual Property and Technology group, is based in Frankfurt and Munich. She is experienced in all areas of intellectual property and antitrust law and advises on the protection and enforcement of intellectual property rights with a focus on patent infringement proceedings and trademark litigation as well as licensing and cooperation agreements. Ms Schoenbohm has several years of experience working with prominent companies from the automotive, consumer goods, semiconductor and pharmaceutical industry.

She is admitted to practice in Germany and the State of New York.

Brent K. Yamashita is a patent litigator with experience in computer hardware and software, hard disk drive, optical drive, storage system, communication, network and mobile device technologies. He has argued claim construction hearings and conducted ITC patent trials. Mr. Yamashita also prepares and prosecutes patents and reexamination petitions and regularly advises companies on IP issues. His clients range from Fortune 100 companies such as HP, Sun Microsystems and Samsung to technology startups such as mSpot.

Mr. Yamashita was named a Rising Star in the area of Intellectual Property Litigation in 2011 by Super Lawyers magazine. He also was named one of “The Best Lawyers in the Bay Area” in the area of Patent Litigation in 2005 and 2006 by Bay Area Lawyer magazine.

Prof. Dr. Dana Beldiman is a professor at the Bucerius Law School, Hamburg, Germany, where she heads its Transnational Center for IP, Media and Technology Law and Policy. She is also a visiting professor at UC Hastings and a partner of the law firm Carroll, Burdick & McDonough LLP, in San Francisco, concentrating on international intellectual property law and international transactions.


MCLE INFORMATION

California: This activity has been approved for Minimum Continuing Legal Education credit by the State Bar of California in the amount of 1.5 hours in the General category. DLA Piper certifies that this activity conforms to the standards for approved education activities prescribed in the rules and regulations of the State Bar of California governing minimum continuing legal education.

New York: This transitional and nontransitional continuing legal education program has been approved in accordance with the requirements of the Continuing Legal Education Board for a maximum of 1.5 credit hours, of which 1.5 credit hours can be applied toward the Professional Practice requirement. Please note that CLE credit is available for newly admitted attorneys.

New Jersey: This program has been approved by the Board on Continuing Legal Education of the Supreme Court of New Jersey for 1.8 hours of total CLE credit. Of these, 1.8 qualify as hours of credit toward the General category.

CLE credit will be applied for in other states where DLA Piper has an office except in Minnesota, North Carolina and Pennsylvania.
