The Bribery Act 2010 received Royal Assent on 8 April and the main provisions are expected to come into force in April 2011. The Act signals a significant reform of the criminal law to provide a new, modern and comprehensive scheme of bribery offences that will enable courts and prosecutors to respond more effectively to bribery at home or abroad.

If commercial organisations are to avoid falling foul of the new law they will have to develop adequate procedures appropriate to their own circumstances and business sectors, taking into account their size, their area of operations and the particular risks to which they might be exposed.

The government has a statutory duty to issue further guidance for businesses on the meaning of adequate procedures before the Act comes into force. During September and October the Ministry of Justice will be running a short consultation exercise to inform the development of the guidance.
