Associate
|
Joshua Briones is keenly focused on his clients' business objectives, and committed to minimizing the disruptive effects of litigation upon their businesses. His clients rely on his skills as an effective crisis manager and counselor.
Mr. Briones has litigated and tried a wide range of complex business disputes for local, national and international clients, in the areas of consumer class actions, securities, contracts, business torts, copyright and trademarks, deceptive trade practices and fiduciary disputes. Mr. Briones also has international litigation experience. He represents foreign companies doing business in the United States in commercial and regulatory disputes. He has prepared several cases for trial in state and federal courts for cases originating outside the United States, including conducting discovery under international treaties, addressing international conflict of laws issues, and obtaining dismissals under the forum non conveniens doctrine.
Mr. Briones is a member of DLA Piper's Electronic Discovery Readiness and Response Group. He regularly counsels clients on issues relating to records retention, litigation holds, and the preservation and use of electronic information. He is co-chair of DLA Piper's Social Media Practice Group.
While Mr. Briones currently works in Los Angeles, he spent the first five years of his career in DLA Piper's San Diego office.
In 2010, an article he co-authored, "The SEC's Two Pronged Attack on Naked Short Selling," which originally appeared in the November 18, 2009 issue of Bloomberg Law, was nominated by the editors of Securities Law Report as one of the best contributed articles of the fourth quarter.
DLA Piper Committee Service
Mr. Briones is on the Hiring Committee for the Los Angeles office. He is also a member of DLA Piper's Los Angeles Diversity Committee. Mr. Briones is also DLA Piper's Hispanic/Latino Affinity Group leader. He serves on the Los Angeles Pro Bono Committee.

Antitrust Class Actions / Unfair Competition

Defended cellular phone company in a case alleging that our client improperly marketed customer information to third party vendors.

Defended food manufacturer against Section 17200, negligent and intentional misrepresentation, and for breach of express or implied warrantees in connection with product labels and advertising.

Defended Accredited Home Lenders, Inc. against alleged assumption of liabilities, fraudulent transfer and Business & Professions Code Section 17200 violations. Claim of $10 million. Obtained dismissal with prejudice.

Defended major entertainment studio in a case alleging that our client improperly collected sales taxes at various locations throughout the state.
Latin America

Represented Tyco Plastics LLP in Mexico and US civil actions seeking over $1 million in damages arising from delivered, but unpaid goods.

Represented Fortune 500 company in independent investigation into allegations of price fixing activity by corporate officers and employees in Mexico.

Represented major resort real estate developer in investigation into allegations of fraud and embezzlement by personnel in Mexico.

Represented News America d/b/a Fox Group and its Mexican subsidiary against alleged malicious prosecution and false imprisonment by former extra on Titanic production. We obtained stay based on forum non conveniens.

Represented General Mills de Mexico seeking damages for delivered, but unpaid goods.
Pro Bono

Represented African-American woman in a civil rights and personal injury action involving a Los Angeles taxi driver and taxi association. We sought an apology and a formal commitment to refrain from racial discrimination in the future. We obtained a favorable settlement.

Represented Mr. Moore in United States v. Moore, a resentencing case. The goal was not to exonerate the defendant, but to ask that when the court resentenced Mr. Moore that his actual rehabilitation during his incarceration be taken into account. Mr. Moore was resentenced to a term five years shorter than his original sentence, reducing that sentence by a third, because of his successful, profound rehabilitation in prison.

Represented 29 former residents of the Cortez Motel in El Cajon at no cost. We sought damages for retroactive rent abatement, nuisance, relocation, physical injury, emotional distress and lost property. We obtained a favorable settlement.
