Alan L. Kildow specializes in the prosecution and defense of complex commercial litigation, with an emphasis on disputes arising out of banking and insurance transactions. He has represented banking, insurance, and other Fortune 500 clients in civil and class actions involving antitrust, RICO, fraud, breach of fiduciary duty, lender liability, kickbacks, and racial discrimination. Mr. Kildow also represents banking and insurance clients in investigations, enforcement proceedings, and civil litigation with regulators and attorneys general.

Mr. Kildow began his career as an international banker and went on to a domestic and international transactional banking practice that included mergers and acquisitions, regulatory compliance, and lending transactions. Since focusing his practice on litigation, Mr. Kildow has also represented financial institutions and insurers in litigation and disputes involving bankruptcy adversary proceedings, restructurings, and insolvency issues.

Mr. Kildow is an experienced civil trial and appellate attorney, having tried dozens of bench trials, jury trials, regulatory proceedings, and arbitrations. He has defended numerous consumer class actions brought under both federal and state law. Mr. Kildow has appeared in state and federal courts in more than 20 jurisdictions, including New York, Connecticut, New Jersey, Florida, Illinois, California, Washington, Wisconsin, and others. He has lectured on substantive subjects in continuing professional education courses, including lender liability, insurer bad faith, and Article 9 of the Uniform Commercial Code.

  • Represented national financial institution and insurance intermediary in massive multidistrict putative class action—In re Insurance Brokerage Antitrust Litigation—involving antitrust and RICO claims arising out of governmental investigations of the insurance industry.
  • Represented national insurance intermediary in multiple federal district court actions arising out of the collapse of the Unicover Workers’ Compensation Reinsurance Pool, where damages were alleged to exceed $ 2 billion.
  • Represented national financial institution in series of civil actions that included lender liability claims arising out of the reorganization of $100 million redevelopment project.
  • Represented national financial institution in a dispute involving fraud in asset-based debt facility where damages were alleged to exceed $200 million.
  • Represented national insurance intermediary in action involving business interruption claims where damages were alleged to exceed $120 million.
  • Represented national insurance intermediary in action involving insurance coverage where alleged losses exceeded $25 million.
  • Represented creditors in dispute arising out of the financing of the purchase of $500 million privately-held company.
  • Represented a Fortune 100 company in a highly-publicized federal class action alleging racial discrimination.
  • Represented a regional transit authority in a highly-publicized federal class action alleging discrimination under the Americans With Disabilities Act relating to access of handicapped citizens to public transportation.
  • Represented insurance underwriter in multiple state compliance investigations and enforcement proceedings involving the collapse of health insurance and workers’ compensation pool.
