Jay Hailey practices in all areas of commercial real estate law, including zoning and other land use matters.

The respected English research firm Chambers & Partners recognizes Mr. Hailey in Chambers USA: America's Leading Lawyers for Business, citing his "extensive experience" and describing him as "extremely confident, levelheaded and thorough" and "very much a problem-solving attorney." Chambers also recognized Mr. Hailey's zoning work in Austin where he has "forged solid relationships with government officials."

He is listed in The Best Lawyers in America for real estate and banking and has been recognized in 2010 as the Best Lawyers' Austin Banking Lawyer of the Year and 2011 as the Best Lawyers' Austin Real Estate Lawyer of the Year. Mr. Hailey has been named a Texas Super Lawyer, in a joint project of Texas Monthly and Law & Politics magazines, for real estate.

Mr. Hailey represents clients in complex transactions, including the structuring of partnerships, limited liability companies, ground leases, tenancies-in-common, condominium regimes and other forms of ownership for mixed use projects and master planned communities; the purchase, sale, financing, zoning, development and construction of office, industrial, retail and residential projects; the creation of public-private partnerships; and the negotiation of financial incentives and development agreements with governmental entities.

Recent transactions include:

  • Negotiation of ground leases, retail subleases and development agreements for construction of a large mixed use project on two blocks of city-owned land in downtown Austin.
  • Assistance with securing land acquisition, zoning and other entitlements for several high-rise residential condominium projects in downtown Austin.
  • Structuring of a partnership between retail and residential developers and creation of a condominium regime for the residential component of a regional mixed use lifestyle retail center.
  • Negotiation of restrictive covenants, license agreements, easements and other development agreements for a mixed use urban in-fill project on state-owned land.
  • Negotiation of acquisition, development, and co-tenancy ownership agreements for a large master planned, mixed use project on state-owned land and adjacent brownfield site.
  • Purchase and sale of several high-rise office buildings and tracts of land in downtown Austin.
  • Purchase, financing, and subsequent resale of several tracts of land for a master planned golf course community, including a large retail center.
  • Negotiation of ground leases, easements and other documents, title review, and due diligence work for land acquisition, construction and financing of several West Texas wind power projects.
