About

As Vice Chair of the US Patent Litigation practice, Katie Grasso is an experienced first chair trial attorney for some of the world's largest medical device and technology companies. With over 25 years of experience, Katie handles patent cases through trial in federal district courts including cases in the most active districts in Texas, Delaware, and California. Katie has tried over 20 cases to verdict (including three this year), and several more through jury selection and into trial. She has tried patent cases involving a variety of technologies, including medical devices, network security and anti-virus software, pharmaceuticals, and wireless communication devices.

Katie also regularly helps counsel clients on patent portfolios including standard essential patents and has significant experience counseling clients and trying cases related to various employment matters, including trade secret disputes, wage and hour disputes, and employment discrimination.

EXPERIENCE

Katie's recent litigation matters include:

  • Spectral Instruments Imaging, LLC v. Scintica Inc., case no. 4:22-cv-00043 (SDTX) –Took over as lead counsel for Spectral in a critical competitor-versus-competitor patent dispute in the Southern District of Texas. Spectral asserted a foundational patent related to cancer diagnostics against its competitor, Scintica. The case faced additional complexities when both parties were acquired during litigation—Spectral by Bruker and Scintica by Vilber. After a successful Markman ruling, we were able to achieve a favorable settlement for Spectral
  • Colibri Heart Valve LLC v. Medtronic CoreValve LLC, et al., case no. 8:20-cv-847 (CDCAL) – Representing Medtronic in a patent infringement matter defending against a two-patent case related to heart valve technology. Colibri alleged willful infringement of two patents related to Medtronic’s transcatheter aortic valve replacement ("TAVR") systems used for minimally invasive treatment of aortic stenosis, which is a common form of heart valve disease. The Court granted Medtronic’s motion for summary judgment of noninfringement of the '739 patent, dismissing one of two asserted patents from the case, eliminating all claims directed to the CoreValve accused product and limiting Colibri’s claims to indirect (induced) infringement of the '294 patent’s method claims. A jury ruled in Colibri’s favor, finding no invalidity and infringement of the other patent. The Federal Circuit reversed the district court, agreed with Medtronic, and invalidated the patent
  • Honeywell v. Zebra – USITC; Western District of Texas; Eastern District of New York. Katie was counsel for Honeywell in a large-scale patent dispute involving over forty cases asserted in the United States and worldwide. Acting as trial counsel and worldwide manager, Katie managed the cases ensuring consistent positions and strategy. Katie and the DLA team ultimately obtained a settlement of $360 million for Honeywell on the eve of the first ITC trial
