Mark Grantham focuses his practice on trial and appellate work in both state and federal courts and complex arbitration matters in domestic and international arbitration forums. His trial experience includes bank merger litigation, major insurance coverage disputes, class actions and securities fraud, employment discrimination cases, construction/engineering litigation and arbitration, and general commercial and international litigation, arbitration, and mediation.

Mr. Grantham has substantial experience in domestic and international arbitration matters involving the design engineering profession, trade disputes, and general commercial disputes.

Chambers USA: America's Leading Lawyers for Business lists Mr. Grantham, describing him as an "accomplished trial and appellate litigator with broad expertise in commercial litigation, including securities class actions. He is also an experienced arbitrator in both domestic and international arbitration forums."  Chambers has noted that clients recognize him as "a skilled litigator who is willing and able to take a matter to trial where necessary. His tactics are effective, and he presents technical material well." Mr. Grantham has been named one of Georgia's 2004 Legal Elite, a listing of the state's "most effective lawyers," in Georgia Trend magazine in December 2004. He has repeatedly been named a Georgia Super Lawyer in the area of business litigation, as the result of a joint research project conducted by Atlanta and Law & Politics magazines. He has been listed in The Best Lawyers in America.

Relevant Experience

  • Has tried jury and bench trials in state and federal courts nationwide concerning contract claims, employment discrimination claims, ad valorem tax assessments, various product liability cases such as the fatal crash of an F-16 fighter jet, and professional engineering malpractice claims.
  • Served as lead trial counsel in a 100-day long jury case in which the firm successfully won defense verdicts for a major US-based international civil engineering firm against claims by the plaintiff, a light rail transit agency, in excess of $100 million on allegations of breach of contract, professional engineering malpractice, and fraud. The jury also awarded the client $2.56 million on its counterclaims. Prior to appeal, the case settled favorably for the client, including a substantial award for attorneys' fees and costs.
  • Handled international arbitration cases in Europe, Asia and the United States administered by the American Arbitration Association, the International Chamber of Commerce, the London Court of International Arbitration, and the Thai Arbitration Institute.
  • Litigated, arbitrated, and/or mediated numerous engineering and construction disputes on behalf of project owners, design engineering firms, and general/prime contractors concerning a wide variety of projects including nuclear and fossil fuel power plants, airports, bridges, rail transit, highway design and construction, shopping malls, wastewater treatment and sewer systems, various industrial plants, turbine generators, commercial buildings and hotels, and an EPA Superfund remediation site.
  • Has successfully mediated over 100 cases involving aggregate claims in excess of $1 billion.
  • Has served as arbitrator in various commercial, business, and engineering/construction disputes.
