Tom is a member of the Litigation and Arbitration group and is based in the Dubai office. His area of expertise includes all aspects of dispute resolution including litigation, international arbitration (under all the major institutional rules) and various forms of alternative dispute resolution.

Tom has acted on behalf of federal and state governments, investment banks, clearing banks, international IT and telecommunication providers, corporations in the oil and gas sectors and pharmaceutical companies.

Tom is a member of the London Court of International Arbitration, the Chartered Institute of Arbitrators and the Dubai International Arbitration Centre. He has spoken at various conferences on international arbitration practice and procedure, including investment treaty arbitration.

Tom has written numerous articles which have appeared in publications such as the Commercial Litigation Journal, The New York Law Journal, The Journal of International Banking and Financial Law, Energy Risk, Energy World, The Lawyer, the ICC Handbook and the Lloyd's List.

Key experience:
  • Acting on behalf of a federal government in relation to claims brought under a bilateral investment treaty. The claim was for in excess of US$5bn and was described, at the time, as being the largest international arbitration based on value of dispute.
  • Advising a leading US investment bank in respect of a bespoke alternative dispute resolution procedure. The multimillion pound claim related to disputed trades in the distressed debt market.
  • Representing a public body and city mayor in successfully defending a challenge by way of judicial review to the mayor's decision to introduce an inner city traffic management scheme. The proceedings were expedited and went from issue to trial inside three months. The case involved detailed evidence on technical issues as well as complex legal argument concerning human rights and interpretation of the application of European directives.
  • Acting on behalf of an offshore bank in relation to a multimillion dollar claim in the English Commercial Court against insurers under a film finance insurance policy.
  • Acting on behalf of an African government in relation to a circa US$50m Commercial Court claim in relation to a purported assignment of sovereign debt to a US investor.
  • Advising an oil pipeline consortium in relation to arbitration proceedings concerning a multimillion dollar dispute under a quality bank system.
  • Representing a leading firm of forensic accountants in relation to a multi-jurisdictional claim for breach of trust following the liquidation of an African bank.
  • Acting on behalf of an international development bank in relation to claims arising out of the liquidation of BCCI.
  • Advising a major UK utilities company on an appeal before the House of Lords in relation to the application of a pension scheme surplus.
  • Acting on behalf of an Eastern European government in a US$40m ICSID arbitration.
