Richard Kremen concentrates his practice in the area of bankruptcy, commercial lending, title litigation and complex commercial litigation, including defense of lender liability suits and contract litigation. He regularly represents financial institutions. He has substantial litigation experience at both the trial and appellate levels.

Mr. Kremen has been a member for over 25 years of the Panel of Bankruptcy Trustees. He has also served as a Chapter 11 trustee in many operating and non-operating Chapter 11 cases.

Representative bankruptcy court cases in which Mr. Kremen has been actively involved include:

  • In re Old Carco LLC (f/k/a Chrysler LLC) (Bankr. S.D.N.Y. 2009): Counsel for one of the largest creditors in the Chapter 11 Chrysler bankruptcy filed in the Southern District of New York.
  • In re Nortel Networks, Inc. (Bankr. Del. 2009): Represented one of the largest creditors in Nortel, a multi-national bankruptcy filing which was filed in Canada, Delaware and Europe. Represented creditor in all three jurisdictions.
  • In re Caruso Homes, Inc. (Bankr. D. Md. 2008): Represented one of the largest secured creditors in this large home builder bankruptcy filing in Maryland.
  • In re Tweeter Entertainment Group Inc. (Bankr. Del. 2007): Counsel to one of the largest consignors of goods to this national retailer.
  • In re Saint Vincent Catholic Medical Center of New York (Bankr. S.D.N.Y. 2005): Counsel to one of the largest creditors in the Chapter 11 bankruptcy cases filed by the largest Catholic hospital system in New York.
  • In re Kmart Corp. (Bankr. N.D. Ill. 2002): Represented Sara Lee and other large unsecured creditors in the Kmart cases in the Northern District of Illinois.
  • In re US Airways Group., Inc. (Bankr. E.D. Va. 2002): Counsel to the largest secured lender in connection with US Air’s Chapter 11 proceedings in the Eastern District of Virginia.

Mr. Kremen also regularly writes and lectures on topics concerning loan workouts, lender liability issues, and bankruptcy law, including representation of secured creditors, solicitation and representation of creditor committees, retention of turnaround professionals and financial advisors, litigating cases in the bankruptcy courts, analyzing and managing ethical issues that arise in bankruptcy cases, and recognizing and reporting bankruptcy crimes, fraud and other abuses of the bankruptcy process. Recently, he has spoken at conferences or seminars for the National Conference of Bankruptcy Judges, Commercial Law League of America, the American Bankruptcy Institute, and the Turnaround Management Association. Mr. Kremen is also a featured panelist and speaker at the Advanced Bankruptcy Institute on Business Bankruptcy presented by the Maryland Institute for Continuing Professional Education of Lawyers.
