DLA Piper advises Hawaiki on divestment of its submarine cable

Global law firm DLA Piper have advised Hawaiki on its divestment of 100% of its interest in the Hawaiki Submarine Cable. The divestment was made to BW Digital Pte. Ltd with the current Hawaiki team continuing to manage the business.

This cross border transaction required input from five distinct jurisdictions due to the highly regulated environment in which the target group operates. The subsea cable has landing points in Equinix's SY4 data centres in Alexandria, Sydney, at Mangawhai Heads on New Zealand's North Island, American Samoa, Hawaii and in Pacific City, Oregon.

The DLA Piper team was led by partner Emma Kendall with support from senior associate Alexander Samson. The cross border team also included partner Martin Wiseman from New Zealand, partner Mike Conradi from the United Kingdom (international sub-sea cable expert) and partner Mike Hazzard from the United States (international telecoms experts).

Emma Kendall commented on the deal saying “DLA Piper is seeing a strong market internationally for alternative infrastructure assets. This very pleasing transaction for the Hawaiki sub-sea cable shows how well the market for data assets has weathered pandemic disruptions. Our international team of sub-sea cable and telecoms experts and transaction lawyers was delighted to partner with the Hawaiki team across five countries to deliver this deal.”
