Clancy O’Donovan’s practice focuses on dispute resolution and insurance, particularly transactional risk insurance (warranty and indemnity), professional indemnity, management liability and property insurance.

He regularly acts for and advises leading Australian and overseas (re)insurers on technical coverage issues – both contentious and non-contentious – across a range of financial, property and transactional product lines.

He acts as defence counsel in litigation in the Superior Courts of New South Wales and the Federal Court of Australia on behalf of a range of professionals, including construction professionals, financial planners, medical practitioners, directors and officers. Clancy also has experience acting in class action proceedings and international commercial arbitration.

EXPERIENCE

  • Acting for an insurer in relation to a coverage dispute concerning a warranty and indemnity claim valued in the hundreds of millions of dollars.
  • Acting for an insurer in industry test case proceedings concerning insurance coverage for business interruption loss arising from the COVID-19 pandemic.
  • Acting for and advising a diverse range of construction professionals in defence of claims arising from alleged negligence, breach of contract and/or contraventions of the Australian Consumer Law. These disputes often involve multiple parties and complex issues associated with causation, damage, expert evidence and proportionate liability.
  • Acting for an overseas insurer in arbitral proceedings commenced before the Singapore International Arbitration Centre in relation to a multi-million dollar coverage dispute.
  • Acting for an employer in Federal Court class action proceedings commenced by previous employees alleging breach of contract and statutory contraventions.
  • Acting for and advising the insurer of an allied health practitioner in relation to a catastrophic injury claim valued in the many millions of dollars.
  • Acting for and advising the president of a charitable organisation in relation to a unique and unprecedented regulatory inquiry, commissioned to investigate alleged financial wrongdoing.
