Modernization of Cosmetics Regulation Act of 2023

The Modernization of Cosmetics Regulation Act (MoCRA) was signed into law in 2022. MoCRA is the most significant expansion of the FDA’s authority to regulate cosmetics since the passage of the Food, Drug, and Cosmetic Act in 1938. MoCRA’s first compliance deadline for registration and listing is December 29, 2023. In addition, FDA will be issuing regulations over the coming months that will affect almost every aspect of the cosmetic industry, including rules relating to GMPs, safety substantiation, product labeling, and recalls. MoCRA also provides FDA with additional authorities to enforce these new rules.
