About

Werner advises local and international clients on all aspects of competition law, including merger control, cartel and other prohibited practice investigations, dawn raids, exemption applications, and competition law compliance and training. His experience includes advising clients in the industrials sector—particularly manufacturing, agri-processing, and infrastructure-linked industries. Prior to joining DLA Piper, Werner worked in the competition practice of another leading South African law firm and spent four years at the Competition Commission of South Africa.

Werner has been involved in various high-profile transactions and investigations across a range of sectors, with a strong focus on matters before the South African competition authorities. He has extensive experience advising on transactions and regulatory issues in the manufacturing, agri-processing, and broader industrials sector, as well as financial services, FMCG, information technology, and telecommunications. 

 

EXPERIENCE

  • Barloworld on all aspects of a c.USD1bn cash offer from a consortium including the Barloworld CEO and Saudi Arabian-based Zahid Group to acquire all of the issued shares in Barloworld.
  • ASP Isotopes Inc. and its acquisition of the entire issued share capital of Renergen by way of a scheme of arrangement.
  • Haier Smart Home on the acquisition of Electrolux Groups complete equity interests in its subsidiary Electrolux South Africa for ZAR2.45bn.
  • Community Investment Ventures Holdings Proprietary Limited (CIVH) and its subsidiary, Maziv Proprietary Limited (Maziv), before South Africa's Competition Appeal Court (CAC), conditionally securing approval for the proposed ZAR14 billion merger involving Vodacom Proprietary Limited (Vodacom) and Maziv
  • Shoprite Checkers in its disposal of its furniture business to Pepkor Limited for ZAR3.0 bn.
  • Shoprite Checkers (Pty) Ltd and its acquisition of the retail grocery stores owned by Massmart Limited.
