Sergio Valente focuses his practice on appellate litigation, administrative law, and complex motion practice. He has represented clients in appeals before the DC Circuit, Ninth Circuit, Second Circuit, and Fifth Circuit, as well as in proceedings before state administrative agencies. His appellate experience spans constitutional challenges, regulatory disputes, and statutory interpretation matters, often involving high-stakes issues.

Sergio was a principal drafter of a pro bono amicus brief to the United States Supreme Court in FCC v. Consumers’ Research, addressing administrative law and agency authority. He also briefed a criminal appeal before the DC Court of Appeals and has contributed to appeals involving agency decision making and First Amendment rights.

In addition to his appellate work, he has drafted several dispositive motions as well as motions for preliminary injunction and complaints in matters ranging from consumer class actions and business-to-business contract disputes to plaintiff- and defense-side trade secret litigation. His practice reflects a deep understanding of both procedural strategy and substantive legal issues across federal and state courts.

  • Representing a Fortune 500 company in a contract and trade secret dispute where the plaintiff seeks up to $300 million in damages
  • Represented a Fortune 500 company in a consumer privacy class action case, resulting in the voluntary dismissal of all claims after a motion to dismiss
  • Represented an international banking client in a Second Circuit appeal obtaining an affirmance of the trial court’s dismissal for lack of personal jurisdiction
  • Represented a large manufacturing company asserting claims for trade secret misappropriation and breach of contract and seeking a preliminary injunction, resulting in a prompt settlement
  • Represented a group of former FCC Commissioners in an amicus brief for FCC v. Consumers’ Research, which Justice Kagan’s majority opinion cited with approval
