Alexa Ain is a litigator who represents corporate and individual clients in complex, high-stakes commercial disputes and government enforcement actions. She guides clients through sensitive inquiries with a focus on risk mitigation and strategy development calibrated to business objectives. Alexa supports her case teams from early fact development through motion practice and resolution, bringing practical judgment, disciplined case management and clear, solutions-oriented communication to every engagement.

Alexa regularly represents companies and individuals in investigations conducted by the United States Department of Justice (DOJ) and the Securities and Exchange Commission (SEC), as well as other federal and state government and regulatory agencies. Her civil litigation practice spans claims brought under the Trafficking Victims Protection Act, purported class actions, and proceedings involving negligence, fraud, breach of contract, and related business torts. Her diverse experience encompasses internal investigations, fact development, discovery management, depositions, witness preparation, and briefing and motions practice.

Alexa also has experience representing clients in arbitrations and bankruptcy litigation.

Government Investigations and Enforcement
  • Advising a medical software company in a DOJ False Claims Act investigation into alleged manipulation of billing-related software settings that allegedly triggered reimbursement for unnecessary medical services by Medicare and third-party payers
  • Advised a durable medical equipment (DME) manufacturer in connection with an SEC investigation concerning alleged material billing fraud, ultimately resulting in a no-action letter
Securities and Corporate Governance Litigation
  • Secured dismissal at the pleading stage of a federal securities class action in the US District Court for the Northern District of Ohio against the former CEO of an industrial manufacturer, defeating Section 10(b) and Rule 10b-5 claims alleging concealment of environmental issues at a plant in Mexico and misstatements about another facility’s capabilities
  • Resolved claims for less than 15% of claimed damages on behalf of the board of directors of a public company in a federal securities and breach of fiduciary duty action challenging a termination fee in an acquisition agreement pending in the US District Court for the District of Maryland
Commercial and Construction Disputes
  • Obtained dismissal with prejudice for a Maryland title insurance company in the Circuit Court for Baltimore County, Maryland in a multi-count breach of contract action
  • Represented a Fortune 500 company in an American Arbitration Association (AAA) arbitration arising from a US$140 million corporate headquarters construction dispute, including defense against delay and scope-change claims
Data Privacy and Cybersecurity Litigation
  • Secured dismissal with prejudice at the motion to dismiss stage of a putative class action in the US District Court for the District of South Carolina arising from a criminal cyberattack
  • Assisted in securing a favorable settlement for a healthcare operational management and business consulting company in consolidated putative nationwide class actions in Maryland state and federal courts following a data breach, addressing claims including negligence, negligence per se, breach of third-party beneficiary contract, unjust enrichment, violations of the Maryland Consumer Protection Act and Maryland Personal Information Act, breach of fiduciary duty, and declaratory judgment
