About

Tony Holloran is a litigator with extensive experience advising landlords, institutional investors, and multinationals across property and leasing, construction and energy, insolvency, telecommunications, licensing, and commercial litigation.

He specialises in real estate litigation, including enforcing lease obligations, resolving break option disputes, dilapidation and repair obligations, and advising on Electronic Communications Code and building safety claims.  He also advises on energy, insolvency, and licensing disputes.

Tony has rights of audience in the Scottish Courts, appearing regularly before the Sheriff Courts and the Lands Tribunal for Scotland, in mediations and arbitrations, and instructing counsel in the Court of Session.

Tony is the author of various Practice Notes on Property Litigation topics published by LexisNexis. He is also a judicial member of the First-Tier Tribunal for Scotland, and a Non-Executive Director and Charity Trustee of a youth homelessness charity in Scotland.

EXPERIENCE

Property and Leasing 

  • Advised a leading commercial landlord on enforcing the ‘keep open’ obligations in a retail shopping centre commercial lease.
  • Managed telecommunication disputes for a commercial landowner- investor client across their Scottish land portfolio, including pursuing and defending claims brought under the Electronic Communications Code for access rights and enforcement of removal.
  • Advised the commercial arm of a public body on enforcement of a rent abatement claim following insured risk damage in arbitration proceedings.

Energy 

  • Advised a major utility provider on enforcement of commercial contract terms and obligations arising under The Commercial Agents (Council Directive) Regulations 1993.
  • Acted for a leading smart meter operator to resolve a UK-wide contract dispute arising from its national metering rollout. 
  • Advised an international cable manufacturer in a product liability and construction dispute concerning a sub-sea energy cable installation.

Insolvency

  • Acted for the Scottish Administrators of a Luxembourg registered company subject to dual insolvency proceedings in the Scotland and Luxembourg. 
  • Secured the sequestration of a high-net-worth individual for a multinational company, petitioning the Sheriff Court.

Licensing

  • Advised a leading Purpose Built Student Accommodation Provider to secure a housing with multiple occupancy (‘HMO’) licence, following enforcement action being taken by the Local Authority’s licencing officer.
  • Advised a national retailer on overturning a Licensing Board’s over-provision decision before the Sheriff Court.
