Businesses are working hard to improve their environmental performances, transition their businesses away from unsustainable activities and minimise high carbon business practices. As part of this transition, most businesses have never been more committed to being transparent about their environmental impact. Yet, at the same, they face the challenge of significant cross-border litigation relating to their emissions, market disclosures, consumer statements and the reorientation of their customer base.

As we look ahead in 2023, Jean-Pierre Douglas-Henry (Partner and Managing Director, Sustainability & Resilience); the Hon. John Middleton AM KC (Senior Advisor, Litigation & Regulatory and Former Federal Court Judge), Tricia Hobson (International Sector Leader for Insurance for ESG); Keara Gordon (Global Co-Chair, Class Action Litigation Practice Group); Jeremy Sher (International Co-Head of Class Actions); and Kelly Sporn (Special Counsel, ESG) will form a global panel in our Sydney office to discuss:

  • the size and scope of the litigation risk facing businesses;
  • three specific litigation risks: shareholder and NGO activism; claims for misleading market disclosures; and green-washing;
  • methodology for developing a climate litigation defence strategy;
  • what actions businesses can take to prevent and defend litigation; and
  • views from the Bench.

This event is part of series of DLA Piper events covering global issues targeting ESG risk taking place this week and beyond. DLA Piper is also proudly hosting, in partnership with Pollination and Global Success Partnership, the ESG Leadership Summit of Oceania in our Sydney office the same week.
