Five developments to read for October in less than 5 minutes.

Continuing trend: Remote working
While remote and hybrid working arrangements are commonplace for many employers, regulators continue to play catch-up. This month we reported on the progress of the draft “Work where you want” bill in the Netherlands which, despite its name, would only provide limited rights for employees to change their place of work. In Brazil, a revised law on remote working requires employers to track hours and make overtime payments. In Mexico, health and safety considerations are the focus of proposed new regulations for teleworking.
Whistleblowing: helping you keep up to date
View our tracker on local country implementation of the EU Whistleblower Protection Directive for the latest developments, including the publication of draft legislation in Belgium and Finland. Most significantly during October, in Ireland, the commencement date for the incoming legislation has been set as 1 January 2023, giving employers some, but not much, time to ready themselves for compliance. Also, in France, the long-awaited Application Decree has been published, setting out detailed requirements for internal reporting channels, which employers should now implement/update as a priority.
US in focus

Two long-awaited proposed federal rules – the NLRB’s proposed standard for determining joint-employer status and the DOL’s proposed rule regarding independent contractor classification – could increase the risk of joint-employer liability and misclassification claims for US employers.

Compliance also remains burdensome as states and localities continue to enact new laws. In California, for example, employers face new obligations related to pay transparency and reporting, leave, and cannabis use, among other issues.
