Catherine Campbell focuses on several traditional and emerging areas of environmental law.
Her practice focuses on emerging areas of environmental law, including the legal aspects of domestic and international carbon credit (or "offset") markets. She focuses on the development and structuring of emissions reduction projects under the Verified Carbon Standard and Kyoto Protocol's Clean Development Mechanism. She also negotiates the purchase and sale of carbon credits, drafting the related agreements and conducting diligence on the crediting projects. She has advised clients on the establishment of carbon credit registries and offers strategic counseling on navigating the dynamic carbon market. Catherine draws upon her experience as Executive Director of a nonprofit that supports a carbon credit project developer and her more than 15 years’ experience advising clients on the evolution of the voluntary carbon market.
Catherine also focuses on environmental matters relating to corporate and real property transactions. She performs environmental diligence and negotiates the allocation of environmental liabilities for clients seeking to acquire properties and businesses, for clients offering properties or businesses for sale, and for lenders underwriting loans. Her experience includes cross-border transactions for the acquisition of manufacturing businesses in a wide range of industries; the disposition of retail gasoline service stations in various markets across the country; and the acquisition, financing, development and redevelopment of commercial and residential properties. She routinely works with clients on environmental assessments of real estate in business acquisitions and prior to acquisition and development of real property. She also works with clients to develop and implement strategies to investigate and remediate properties with known or suspected environmental contamination.
Catherine also handles a broad range of regulatory and compliance matters, including those arising under the Clean Air Act, Clean Water Act, TSCA, CERCLA/EPCRA and other federal environmental statutes and their state counterparts. This includes environmental enforcement actions, permitting, and tracking and reporting on recent rulemaking and EPA policy interpretations. Catherine regularly interfaces with the EPA on behalf of her clients, including defending enforcement actions brought by the EPA, negotiating regulatory hardship exemptions and responding to governmental requests for information. She also assists clients in responding to facility emergencies, including the coordination of reporting obligations and on-site internal investigations.
