Sean Fulton is a seasoned generalist litigator and has extensive experience counseling and representing multinational companies in "bet-the-firm" state/federal litigation, including products liability/mass torts, securities class actions, employment, antitrust, bankruptcy, and other complex commercial disputes. He has also represented those clients in related regulatory investigations brought by the US Department of Justice, the US Securities and Exchange Commission, and state attorneys general. Those multinational companies include leaders in the automotive, alcohol/spirits, banking, cryptocurrency, e-commerce, energy, manufacturing, and wireless carrier industries.

Sean has particular expertise in artificial intelligence (AI), cryptocurrency, and other emerging technologies, and leverages his extensive litigation experience to advise organizations on the risks associated with adopting such technologies. He has advised numerous Fortune 500 organizations on implementing and maturing enterprise-wide AI governance frameworks and designed and led legal red teaming exercises for AI use cases across various industries. Sean also regularly advises clients on risks associated with technology transactions. He is a thought leader on issues at the intersection of technology and the law and regularly publishes and speaks on these areas.

Sean also maintains an active pro bono practice. He is currently serving as pro bono counsel for the National Center for Law and Economic Justice in federal impact litigation involving a state's implementation of the federal Supplemental Nutrition Assistance Program (SNAP). He also acted as lead pro bono counsel in a class action brought by tenants against their landlord and an arbitration brought by a charter school against a construction company.

  • Represented one of the world's largest cryptocurrency exchanges in Chapter 11 bankruptcy proceedings
  • Represented a major spirits manufacturer in securing a declination letter from the US Securities and Exchange Commission in connection with information requests related to the company's business operations in certain foreign markets
  • Represented major mobile wireless network carrier in securing post-judgment relief from consent decree divestiture obligations
  • Represented one of the world's largest automobile manufacturers in numerous federal and state actions, including multidistrict litigation and regulatory investigations by federal and state authorities
  • Represented an automotive parts manufacturer in securing dismissal of a securities fraud class action brought by shareholders alleging that the company publicly misrepresented the state of a meaningful segment of its business
  • Represented the foreign affiliate of leading energy company in an International Chamber of Commerce (ICC) arbitration involving a contract dispute, which resulted in a US$600 million award for the client
  • Represented an African e-commerce company in connection with an internal investigation and advising on its compliance program and internal controls
