Madelaine Hogan is a projects lawyer with over 8 years’ experience assisting multinationals, government bodies, developers, principals and tier 1 contractors with projects, infrastructure and construction contracts, dispute avoidance and resolution.

Madelaine has practiced from Brisbane, Edinburgh, Port Vila and Perth, so is no stranger to the complexities that arise with cross-jurisdiction projects. From those bases, she has advised and acted for clients in a range of matters throughout Australia, Asia Pacific, the United Kingdom and the Middle East, including projects and construction contract drafting, management and administration, dispute resolution including ICC arbitrations, and complex security of payment disputes.

Since arriving in Perth in February 2020, Madelaine assisted in the representation of a multinational construction and engineering joint venture contractor in an ICC arbitration (valued in excess of USD 1 billion), arising out of a multi-billion dollar LNG project off the coast of northern Australia.  During this time, Madelaine has also drafted and advised clients on a variety of construction, project and mining infrastructure related contracts, in Western Australia and the broader Asia Pacific region.

Between 2018 and 2020, Madelaine undertook a pro bono secondment to the Prime Minister’s Office of the Government of the Republic of Vanuatu, providing contracting, project management and legal assistance to government departments in Port Vila.

EXPERIENCE

  • Assisting PT Unilever Oleochemical Indonesia with the procurement and construction of its oleochemical processing plant in North Sumatra, Indonesia. This project is a core component of Unilever’s ‘Clean Future’ strategy to replace 100% of the carbon derived from fossil fuels in Unilever’s cleaning and laundry product formulations, with renewable or recycled carbon by 2030.
  • Assisting in the representation of a multinational construction and engineering joint venture contractor in an ICC arbitration (valued in excess of USD 1 billion), arising out of a multi-billion dollar LNG project off the coast of northern Australia.
  • Advising Bellevue Gold on the drafting, tendering and negotiation of its AU$400 million Underground Mining Services Agreement for the construction, development and production activities at the Bellevue Gold Mine in Western Australia.
  • Acting for the Western Australian Cricket Association (WACA) on the redevelopment of the WACA ground, in preparing all early contractor involvement and construction documentation, including tender content and document package, equipment supply agreements, minor works agreements, design and construct contract and major works contract.
  • Advising Kalium Lakes on engineering, procurement and construction contracts for its Beyondie Sulphate of Potash Project.
  • Advising the Prime Minister’s Office of the Government of the Republic of Vanuatu on projects deemed to be critical to the development of Vanuatu’s infrastructure. Providing complex legal and project management assistance on the Vanuatu Airport Investment Project, the Vanuatu Inter-Island Shipping Support Project, the Vanuatu Energy Access Project, and the Port Vila Urban Development Project. Liaising and negotiating with international development donors and banks, simultaneously project managing a number of key infrastructure projects from a legal perspective, drafting and negotiating engineering, procurement and construction contracts, drafting and negotiating operation and maintenance agreements, day-to-day contract management advice and assistance, and dispute resolution and avoidance. 
  • Advising Telstra on key infrastructure projects, from planning and contract negotiation to the award of practical completion. Drafting, conducting risk assessments and advising on bespoke contracts, drafting and amending project-specific contract suites, and advising on security of payment requirements, legislative and common law changes.*
  • Advising a North Queensland Sugar company on proceedings brought in the Supreme Court of Queensland regarding a contractual interpretation issue under a logistics operation contract.*
  • Advising a Tier One Contractor in proceedings brought in the Scottish Court of Session regarding delay and disruption to construction subcontractors.*
  • Advising a Tier One Principal in proceedings brought in the High Court of Justice in Northern Ireland regarding the alleged failure to operate a wastewater treatment facility in Belfast as a prudent operator.*
  • Advising an international construction Joint Venture in a multi-million dollar adjudication application, prepared within strict Security of Payment legislative timeframes.*
