  • Representation of an airline in a high profile judicial review of an RFP process valued at $1B. Complex, multi-party action with an injunction, two appeals, seven applications, media and political management.
  • Representation of a school board in a high--profile judicial review proceeding.
  • Representation of a beneficiary in one of Alberta’s largest estates, including a successful and precedent setting decision at the Alberta Court of Appeal respecting the enforceability of No Contest Clauses.
  • Representation at a lengthy trial successfully defending the owners of a signature Calgary office tower against 8 million in builders lien claims for millwork, including resolution of several costs and ancillary matters, an appeal and cross-appeal.
  • Representation trial defending welders for the contracted for construction of a turnkey pump package, including defence of personal charges of fraud.
  • Successful representation of a university and individual executives and employees against several related $2.5 billion claims, including multiple appearances respecting affirmation of a complete dismissal of the Actions at the Court of Appeal.
  • Representation of a foreign engineering company that oversaw the construction of a heavy oil tank farm in Fort McMurray, Alberta in respect of a $70 million claim arising from roof collapses at 2 tanks. This included defence of Occupational Health and Safety charges against the company and officers, as well as a resulting civil action.
  • Successful representation of and settlement of claims against directors and officers of a failed oil and natural gas service and supply company. Defence involved Canadian and US bankruptcy proceedings, multi-Provincial securities commissions proceedings, US Securities and Exchange Commission proceedings and multijurisdictional class action proceedings (claims of $300 million).
  • Successful representation and settlement of claim against directors and officers in Alberta’s largest fraud case at the ASC ($60 million), involving purported oil sands technology and gold mine investors.
  • Representation of a regional air carrier in a $5 million dollar action for damages for conspiracy and wrongful interference with economic relations, with the result being negotiation of an early discontinuance without costs.
  • Successful extrication of the insurers from multiple complex actions for $10 million under a financial advisor’s E&O policy for a failure to cooperate on the part of the insured. Defence legal fees expended by our client prior to our involvement was in excess of $1.5 million.
