• The Dow Chemical Company et al. v. NOVA Chemicals Corporation (T-2051-10/A-379-14/A-43-16) - Acted as co-counsel on behalf of Dow, obtaining judgment for patent infringement concerning polyethylene compositions, disgorgement of the profits associated with the infringement, and a costs award of $6.5 million – believed to be the largest costs award granted by the Federal Court in an IP matter.  The quantification of Dow’s total recovery remains pending before the Court.
  • Arctic Cat Inc. et al. v. Bombardier Recreational Products Inc. (T-1353-13/A-395-16) - represented Arctic Cat in asserting a patent infringement action concerning an electronic ignition timing control technology.
  • Bombardier Recreational Products Inc. v. Arctic Cat Inc. et al. (T-2025-11) – obtained favourable judgment for Arctic Cat in a multi-patent infringement action concerning a frame assembly and configuration of snowmobiles.
  • Astellas Pharma Canada Inc. et al. v. Sandoz Canada Inc. (T-1162-11) - Represented Sandoz in this PM(NOC) application concerning the drug COMBIGAN (brimonidine/timolol) used to treat patients with glaucoma.
  • Valence Technology Inc. v. Phostech Lithium Inc. (T-219-07/A-121-11) - Represented Valence in asserting patent infringement concerning the manufacture of lithium ion batteries, resulting in an injunction and entitlement to damages.
  • Eli Lilly and Company v. Canada (ICSID Case No. UNCT/14/2) - Subject matter expert to the Canadian Government in its defence to a claim brought under the dispute settlement provisions of NAFTA Chapter 11.
  • CSI Global Education Inc. v. Xiaodong Qian, (T-746-10) Obtained judgment, including an injunction and statutory damages, for CSI in relation to online sales of counterfeit training materials.
