Emma Phillips is an employment lawyer, with extensive experience in both contentious and non-contentious employment matters, to include, complex, high value litigation, the protection of business interests, UK and global restructures, M&A and post-acquisition integration, global mobility and executive severance. Her clients include household names in a range of sectors, including manufacturing, energy, technology, insurance, retail and hospitality.

EXPERIENCE

  • Negotiating the exit of senior executives for a number of PLC and FTSE 100 clients, in addition to protecting legitimate business interests via the enforcement of post-termination restraints, including a number of successful applications for injunctive relief in the High Court
  • Planning and implementing an exit programme in the UK, China/Hong Kong and ROI via settlement agreement for a global retailer and household name - exiting 140 senior/executive employees in less than 6 weeks, on time and within budget
  • Advising a global manufacturer on an intra-group asset restructure and UK site rationalisation programme, including the closure of 3 sites, the intra-group transfer of production to The Netherlands and the centralisation of customer services within the client's group. A complex project engaging both TUPE and collective redundancy over a phased transition through 2016/2017
  • Advising a global aerospace manufacturer on post-acquisition integration across 14 jurisdictions, requiring the application of complex TUPE/ARD principles and necessitating a detailed understanding of the client's business globally
  • Advising on the employee implications of the high profile Caparo Industries Plc administration, including advising the administrators, PwC, on a number of sales, comprising a substantial proportion of the Caparo business, salvaging more than 1,000 jobs
  • Representing Santander in the precedent setting case of Woodward v Santander, reaching the Court of Appeal and establishing legal principles in respect of post-termination whistle-blower detriment and without prejudice privilege
