Italy: Data protection information notice

DLA Piper Studio Legale Tributario Associato ("DLA Piper Italy") and DLA Piper International LLP ("DLA Piper International") (DLA Piper Italy and DLA Piper International are also jointly defined as the "Firm") inform you that the personal data provided by you (the "Data") either directly or indirectly including through its fee earners can be processed in compliance with the terms of this privacy information notice.

1. Purposes of the Data processing

The purposes of the processing of the Data by the Firm are:

i) the performance of the professional tasks for which the Firm has been engaged
ii) the compliance with any obligation imposed by the law
iii) the pursuing statistical, administrative, accounting purposes, and
iv) the performance of marketing initiatives including the delivery of marketing communications in relation to the services offered by the Firm.

The consent to the Data processing for the purposes listed in points i) to iii) above (the "Necessary Purposes") is necessary otherwise it will be impossible for the Firm to perform the services required. The provision of sensitive and judicial Data is strictly necessary for the purposes of points i) and ii) above.

With reference to the purposes of point iv) above also by other law firms belonging to the network of which the Firm is a member, the consent is discretionary and if you do not want to provide your consent to the processing of your Data for such purpose, the Firm will not be able to send you marketing communications.

In compliance with article 13.2 of the EU Directive 2002/58 as implemented in the country of establishment of the DLA Piper Italy and DLA Piper International, the Firm will be entitled to send you marketing communications via email if it obtained your email address in the context of the provision of its professional services being agreed that at the time of the collection and on the occasion of each message you will be entitled to object to the delivery of marketing communications through the delivery of email to the address [email protected].

2. Processing arrangements and means

In relation to the above mentioned purposes, the Data will be processed both electronically and in paper form but, in any case, using any such means have been set up in order to minimise the usage of identifiable data that is not necessary for the purposes mentioned above. Additionally, the Firm implemented the security measures prescribed by applicable laws to protected the Data.

3. Scope of Data disclosure and dissemination

Your Data may be disclosed to:

i) individuals who cooperate with the Firm (fee earners, accountants, secretaries, interns and administrative staff) and who act as data processors or persons in charge of the processing according to the circumstances
ii) persons operating in the judicial sector, counterparties and their counsels, members of arbitration panels and in general to any public or private individual/entity to whom the Data must be disclosed for correctly fulfilling the Necessary Purposes
iii) individuals/entities (if any) to whom the Firm may outsource one or more activities
iv) consultants, credit and financial institutions, insurance companies, debt collection companies, all of which will be appointed as external data processors
v) members of the network of law firms to which the Firm belongs.

In case of merger, acquisition or transfer of business, your Data may be transferred by the Firm to the entities involved in such transactions.

Your Data may be transferred to the entities also located in countries the European Economic Area that do not ensure an adequate level of protection to the Data for the purposes of the EU Directive 95/46 as necessary to pursue the Necessary Purposes.

Your Data will not be disseminated, unless such dissemination has been authorized by you.

4. Data Subject's Rights

Pursuant to article 12 of the EU Directive 95/46, you will have the right to obtain, at any time, confirmation as to whether or not personal data concerning you exist, to know their content and source, verify that they are correct or obtain their integration, update or rectification. You shall also have the right to obtain erasure, anonymization or blocking of data that have been processed unlawfully, as well as the right to object, in any case, on legitimate grounds, to the processing of personal data concerning you.
