Gisela has provided counsel regarding copyrights and the assessment of prior permission to include third parties’ work and image in a particular audiovisual project. The assessment allowed the client to launch the project with minimized risks and with their concerns addressed.

Gisela has also provided infringement risk assessment related to the use of a title in an audiovisual performance. The search and the risk assessment were fundamental for the viability of the project.    

Gisela has drafted a comprehensive manual regarding the requirements, obligations and rights listed by the Brazilian Data Protection Law to assist on the analysis of the level of protection provided by the law and the assessment on whether it can be considered a safe country to transfer personal data by foreigner governments. This work will impact on the regulation of international transfers and demonstrates an extensive knowledge of the law. 

Gisela has assisted clients with the development of a personalized data protection compliance program, which encompasses the mapping of the current structure of compliance, the assessment of compliance gaps and the draft of an action plan which will enable the clients to act in compliance with the Brazilian data protection legislations. The compliance project is especially relevant considering the lack of data protection culture in Brazil and the corresponding assistance which must be provided to the client.
