Cameron McCracken is a litigation and regulatory lawyer. He advises and acts for public and private clients in a range of sectors with a focus on insurance, life sciences, financial services and public law. 
He has previously worked for corporate and public entities and understands their differing priorities and interests. 

Cameron's experience includes contract disputes, insurance claims, and judicial reviews. He has appeared as counsel in New Zealand’s High Court, Court of Appeal and Supreme Court. 

Cameron is passionate about LGBTQ+ inclusion. He is active in DLA Piper's rainbow diversity and inclusion committee, Iris, and is a member of the international firm's Iris Represents network which coordinates the provision of pro bono legal services to LGBTQ+ organisations.

EXPERIENCE

  • Johnson v Johnson [2023] NZCA 566Junior counsel for the appellant in a Property (Relationships) Act proceeding who on appeal succeeded in adducing further evidence and establishing additional relationship debts, and successfully defended a cross-appeal that challenged the High Court's finding that advances from a family trust were loans.  
  • Make It 16 v Attorney-General [2022] NZSC 134; Make It 16 v Attorney-General [2021] NZCA 681; Make It 16 Inc v Attorney-General [2020] NZHC 2630Assisting senior counsel in Make It 16's application for a declaration of inconsistency, which was granted on appeal to the New Zealand Supreme Court. He assisted senior counsel with hearing strategy and preparation and appeared in the New Zealand Court of Appeal and Supreme Court. 
  • Johnson v Jarden Custodians Ltd [2022] NZHC 1817Assisting senior Counsel in opposing a summary judgment proceeding that included allegations of breaches of the Fair Trading Act and fiduciary duties, deceit and injurious falsehood. The plaintiff ultimately discontinued the proceeding and gave an undertaking never to reissue a similar claim. Costs of $61,000 were awarded combined 3C and 3B basis, with a 50 per cent uplift.
  • Appearing as counsel in the High Court in Public Works Act proceedings.
  • Applying successfully for summary judgment in the High Court for breach of a disputed investment contract.
  • Advising investment fund trustee and manger in relation to participating and fronting potential representatives/class actions.
  • Advising private clients on regulatory changes within the Therapeutic Products Act.
  • Advising and acting for insurers and insureds in disputed insurance claims. 
  • Investigating and advising on historical trust deed issues arising in in an occupational superannuation scheme.
  • Assisting a local authority in achieving a mediated resolution of a multi-party construction dispute relating to a large capital project.
  • Advising clients on a range of issues affecting local government including contracting queries, contract disputes, emergency responses, and setting of speed limits.
  • Advising local authorities on issues arising from local government elections.
  • Advising public and private clients on official information and Privacy Act 2020 requests and responses.
