Kelly is an experienced litigator with unique expertise in electronic information issues, including electronic discovery (e-discovery), cybersecurity and privacy. 

Kelly is known for her efficient, no-nonsense approach to problem solving and dispute resolution. In 2011, Kelly was named as one of Canadian Lawyer‘s “Top 25 Most Influential Lawyers in Canada.”

Kelly is a recognized leader in electronic discovery and data management issues:

  • She is an expert advisor to Standards Council of Canada, Canada’s member body in the International Organization for Standardization (ISO) network, advising and negotiating with respect to international standards on information technology security and e-discovery.
  • Kelly is an advisor to the IoT Coalition of Canada, a community group of executives, vendors, academics and experts to work on the co-creation of Canadian-based Internet of Things ("IoT") best practices.
  • She is a committee member of ISO/IEC JTC1/ WG 10, an international working group addressing the IoT, focusing on standardization gaps in areas such as vocabulary, terms and definitions, and monitoring IoT regulatory, market, and technology requirements.
  • She is the co-editor of ISO 27050-3, Code of practice for electronic discovery, being part 3 of a developing international electronic discovery standard.
  • From 2010 to 2014, Kelly acted as Chair of the Canadian working group of the non-profit think-tank “The Sedona Conference®” (Sedona Canada) which developed national electronic discovery principles. 
  • Kelly is the Chair of the Precedents Subcommittee of the Ontario E-Discovery Implementation Committee (EIC), which prepares model e-discovery documents to guide litigators and the judiciary in Ontario.

Kelly is an experienced advocate:

  • She has appeared before all levels of court in Ontario and the Supreme Court of Canada.
  • She has represented clients in all manner of commercial and product liability disputes, including shareholders’ disputes, commercial fraud, contract interpretation and class actions. Kelly’s experience spans several industry sectors, including energy, pharmaceuticals, consumer products, banking and securities.
  • She has acted for clients in connection with major regulatory proceedings, including proceedings before the Ontario Energy Board, the Competition Bureau and the Patented Medicine Prices Review Board.
  • She advises clients on privacy compliance and advocates her clients’ positions to privacy commissioners.
