Brian Hochleutner is a partner in DLA Piper's real estate group and serves as counsel to developers and investors in the acquisition, development, sale and leasing of large-scale real estate projects, with a focus on complex joint venture matters.

EXPERIENCE

Brian's experience includes representing:

  • The developer and owner in all aspects of the approximately 161-acre Suffolk Downs project in East Boston and Revere, Massachusetts, which is entitled as a 16 million square foot mixed-use transit-oriented development that will create a new mixed-use neighborhood with approximately 10,000 new units of housing, as well as hotel, office, life science, retail and restaurant space, and approximately 40 acres of new publicly-accessible open space.
  • The developer of the Harvard University Enterprise Research Campus, a 14-acre mixed-use project which is planned to include approximately 1.94 million square feet of new development, including R&D/lab, residential, hotel, conference center, retail and restaurant space, and a new 1.5-acre park to be constructed on university land in Boston opposite the university's business school, including all permitting and entitlement of the project for which construction commenced following closing of a US$750 million construction loan, which we understand to be the biggest construction loan closed in North America in 2023
  • The developer of the Union Square Redevelopment Project, a 20-acre mixed-use transit-oriented development of 3.8 million square feet in Union Square in Somerville, Massachusetts, including negotiating with City agencies, rezoning and obtaining special permits and site plan review approvals, completing the state environmental review process, obtaining other state and local permits, negotiating joint venture agreements, and drafting reciprocal easement agreements and CC&R documents
  • The developer/owner in the redevelopment and sale of NorthPoint, a 45-acre former rail yard in Cambridge, Somerville and Boston, Massachusetts entitled to consist of a 20-building mixed-use project with more than 5 million square feet of residential and commercial space, including handling of all land-use matters
  • The developer of 232 A Street, an approximately 335,000 laboratory/R&D and retail/restaurant project with significant new publicly-accessible open space on an approximately 2.4-acre site adjacent to the Fort Point Channel in South Boston which was previously part of the Gillette manufacturing campus
  • The developer of the 119 Braintree Street project in the Allston neighborhood of Boston, including obtaining zoning relief and Article 80 approvals for development of an approximately 385,700 square foot lab/research and office building and a 7-story 88-unit residential building that will be primarily affordable, including construction of new stairway and elevator connections to the Everett Street bridge and the nearby Boston Landing MBTA commuter rail station
  • US subsidiaries of one of China's largest real estate developers in the formation and structuring of joint ventures for the acquisition, development and financing of major US real estate projects, including the US$5 billion Pacific Park development (formerly known as Atlantic Yards) in Brooklyn, New York and the US$1 billion Oyster Point development in South San Francisco
  • The developer of the Mass + Maine / Market Central project in the Central Square neighborhood of Cambridge, including a zoning amendment and special permit for a 19-story mixed-use project
  • The developer of the Northland Newton Development, an approximately 23-acre, 1.1 million square foot mixed-use project in Newton, Massachusetts that will include approximately 800 residential units, 180,000 square feet of office space and 10 acres of open space
  • A real estate fund in the acquisition of a significant joint venture stake in One New York Plaza, a US$1.4 billion trophy office building located at the southern tip of Manhattan
  • An institutional real estate investor in the formation of multiple joint venture investment vehicles for the acquisition, development and financing of ownership of trophy and class A office buildings in Washington, D.C., including a new trophy 620,000 office building, a new trophy 400,000 office building, and an existing 535,000 SF class A office building
  • A global real estate investment company in the acquisition of a recently-developed Class A office building and parking garage in Boston's Seaport District
  • A real estate investment fund in the acquisition of a mixed-use project that includes a 212-room hotel with related conference space, a separate operating restaurant business, and an office building
  • An institutional real estate investor in the sale of six REITS owning large apartment projects in five different states for more than US$100 million
  • A real estate investment fund acting as mezzanine lender on several large portfolios of industrial and hotel properties located throughout the country
  • Various landlords and tenants in connection with leases for office, retail and industrial properties in major metropolitan areas, including New York, Boston and Los Angeles

Brian has been selected as a Massachusetts Super Lawyer Rising Star, and is a recipient of the Los Angeles County Bar Association's Outstanding Young Lawyer Award and the Girl Scouts of Greater Los Angeles’s Visionary Award.

Brian has published a number of articles regarding real estate law and business matters.  His recent article regarding joint ventures and fiduciary obligations was published in the May 2016 edition of Commercial Property Executive (https://www.cpexecutive.com/post/in-jv-partnerships-mind-the-punctilios/). Brian was also one of the principal authors of Real Estate Investment in the US, the Legal Perspective (http://www.dlapiperrealworld.com/export/sites/real-world/brochures/downloads/United-States-Investor-Guide.pdf), a guide for non-US investors addressed to the most relevant features of investing in US real estate, including the process of buying, selling, development, leasing, and financing real property in the US.

After graduating from law school, Brian clerked for Judge Dennis Jacobs of the Second Circuit US Court of Appeals, in New York City.

Civic, Charitable and Pro Bono

Brian’s has served in various leadership positions with civic organizations and bar association groups.  He has served as an elected town meeting member and as a member of several committees charged with advising on zoning and land use matters in his home town of Brookline, Massachusetts.
