Matt Klepper is an experienced trial lawyer, representing companies and individuals in a wide variety of high-stakes business disputes.

Matt has tried cases in federal and state court throughout the country and has also led cross-border engagements involving multiple proceedings before courts and arbitration forums throughout the world. His experience includes the representation of Fortune 50 companies and high-net worth individuals. Matt regularly handles real estate, contract, fraud and breach of fiduciary duty matters, including disputes arising among the owners of closely-held businesses. Matt is often able to position a case so that it can be successfully resolved without the need for a trial. He is an experienced and practical strategist, counsellor and advocate.

EXPERIENCE

Matt's experience includes the following matters:

  • Representation of a high-net worth individual with business interests throughout the world, including involvement in significant matters in the US, Ireland, Cyprus, the British Virgin Islands, Italy, Russia, Switzerland and Hong Kong. Matt oversees litigation activities in various jurisdictions and also coordinates a team of lawyers in the prosecution of a pending action seeking recovery of more than US$1 billion
  • Representation of a UK company in complex litigation pending in the US relating to alleged auditor malpractice, including the handling of complicated disputes in both the US and the UK relating to international service of process, MLATs and discovery through the Hague Convention
  • Representation of a Fortune 50 company in defense of a high-profile real estate dispute. After a several day evidentiary proceeding, the plaintiff's request for a preliminary injunction was denied. Matt's client was ultimately granted summary judgment as to all matters
  • Representation of a major real estate developer in defending against alter-ego and fraudulent transfer claims
  • Representation of an insurer in connection with a large PONZI scheme, including handling of a complex insurance coverage dispute in New Jersey
  • Representation of a European company and its owner in a US dispute related to matters pending in Europe. The damages sought were in excess of US$100 million. Judgment was entered in favour of Matt's client
  • Representation of a credit agency in defense of security fraud claims filed in NY by various bondholders
  • Representation of an Italian company in the prosecution of claims in the US concerning a major fraud by a US executive of the Italian company
  • Representation of a large reinsurer in a fraud case arising out of the insolvency of a Florida self-insurance fund
  • Representation of an individual client in a trust dispute where the trust held the majority of the voting shares of a large insurance company
  • Representation of the majority owner of a large shopping center in disputes with the manager and minority investor
  • Representation of a bank in a real estate dispute concerning an approximately US$100 million development
  • Representation of a bank in the defense of claims brought by other lenders for breach of several related loan syndication agreements
  • Representation of a Swiss real estate fund in a dispute with its US business partner
  • Representation of a bank in the successful defense of a putative class action in Idaho seeking greater than US$100 million in damages
