Simon Wells is a partner in the firm’s litigation group. He practises in the area of commercial litigation and dispute resolution with an emphasis on real property related matters and has specialized expertise in municipal, environmental, forestry, construction and aboriginal law, and in trespass, commercial leasing and property tax matters.

Simon obtained a Bachelor of Arts degree in English from the University of British Columbia in 1988. He then obtained an LL.B. from the University of British Columbia in 1992.

Simon’s practice encompasses:

He has appeared at all levels of the BC Supreme and Federal Courts.

Real Property Matters

Simon acts in disputes involving the sale of land, commercial lease disputes, property tax appeals, trespass, nuisance and the rectification and interpretation of charges on title.

Environmental Law

Simon acts in a variety of environmental regulatory matters, ranging from the management of accidental spills to Oil and Gas Activities Act appeals. He specializes in contaminated site matters involving the Environmental Management Act and acts regularly in civil cost recovery claims, as well as defending clients in administrative proceedings and challenging the decisions of regulatory officials before administrative tribunals and by judicial review in court.

Municipal Law

Simon has acted for and against municipal governments in regulatory disputes. He specializes in cases involving land use planning, including zoning, development permits and subdivision approval.

Construction Law

Simon has acted in a variety of construction related disputes including engineering and design issues, construction failures and contractual disputes.

Aboriginal Law 

Simon advises clients on aspects of aboriginal law including aboriginal right and title, the duty to consult and the regulatory and statutory provisions applicable to First Nations. 

Forestry Law 

Simon has acted for clients in a number of forestry-related matters including contractor disputes, regulatory disputes and defences, logging trespass and civil injunctions involving protesters.
