Rosie Badgett is a litigator with 25 years of experience handling all phases of litigation – including discovery, trials, and appeals. She focuses her practice on asbestos litigation, environmental law, products liability, and toxic tort law. Rosie has represented companies in many industries, including manufacturers of construction materials, automotive parts, chemicals, and pesticides. She has litigated cases in multiple jurisdictions and has successfully represented corporations through trials, high level settlement negotiations, and varied motion practice.

Throughout her career, Rosie has become adept at helping her clients navigate condensed trial schedules often found in jurisdictions such as California. She has also handled multiple settlement negotiations involving seven and eight figure demands in products liability cases.

Recent successes include a successful summary judgment motion in a silicosis case where the Plaintiff received a double lung transplant; resolution of a matter for a public entity faced with an eight-figure demand in an asbestos matter while serving as lead trial counsel; and a successful summary judgment motion in an asbestos case for a retailer who was faced with a seven-figure settlement demand. Rosie has second chaired multiple asbestos trials in California, Illinois, Maryland, and Texas.

EXPERIENCE

  • Second chair trial lawyer in a matter involving a claimed mesothelioma against a manufacturer of a paper collating machine. Alameda, CA, case resolved after eight weeks of trial.
  • Summary judgment granted in favor of a distributor of quartz and natural stone materials in Los Angeles, CA in the face of a seven-figure demand.
  • First chair trial lawyer in a matter involving a claimed mesothelioma against a public entity. Los Angeles, CA, case resolved the day before trial.
  • First chair trial lawyer in a matter involving a retailer who was sued by a contractor who claimed he was exposed to asbestos through work on the client's premises. Oakland, CA, client's summary judgment was granted in client's favor.
  • Successfully represented a corporate representative in an asbestos matter, resulting in a dismissal after the deposition was completed. Los Angeles, CA.
  • Successfully negotiated a dismissal of an entity accused of negligent Phase I Environmental Site Assessment and violations of the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), Central District of California.

Prior Experience

Rosie began her career litigation cases in Madison County, Illinois and St. Louis, MO. She also participated in trials in Maryland and Texas for her firm's national clients. In 2008 she became a founding member of a products liability and environmental firm in Los Angeles, where she litigated cases throughout the state of California until 2016. From 2016 to 2023 she relocated to San Diego where she continued her litigation practice throughout California and expanded her practice to managing cases in Washington.

Rosie has recently returned to the Mid-West and joined DLA Piper's Chicago office. She continues to litigate products liability, asbestos, silicosis, and talc cases in various jurisdictions.
