
Pam Begaj Loutos
Of CounselPam Begaj Loutos represents clients in complex commercial litigation nationwide, drawing on extensive experience in federal and state trial courts as well as in arbitration proceedings. She has served as trial counsel in high stakes matters and regularly manages all phases of litigation, from pre-suit investigation and discovery through dispositive motion practice and trial.
Pam’s practice encompasses a broad range of industries, with particular experience in healthcare, telecommunications, and cybersecurity. She has litigated matters involving ERISA, RICO, failed transactions, commercial torts, and all types of breach of contract disputes, among others. In addition, she advises and defends clients in professional accounting liability, securities litigation, internal investigations, and class actions.
Recognized for her strategic judgment and unwavering commitment to client service, Pam works closely with clients to understand their business objectives and develop tailored and efficient litigation strategies. EXPERIENCE
- Represented a healthcare insurance company in a complex arbitration brought by a hospital system alleging that defendant improperly underpaid, misclassified, or denied reimbursement claims for out-of-network emergency medical services over a multi-year period and seeking hundreds of millions in damages based on ERISA, breach of contract, and quantum meruit. After a number of multi-week trials, the arbitration Panel ruled in the client’s favor on ERISA, prejudgment interest, and held that certain claims do not constitute emergency services under EMTALA and comparable state statutes. Also secured the dismissal of the state prompt pay claim in the arbitration.
- Secured a favorable settlement on behalf of a healthcare insurance company in a complex arbitration dispute brought by a hospital system alleging that defendant improperly underpaid, misclassified, or denied reimbursement claims for in-network services.
- Obtained the dismissal of all claims against a telecommunications company in a complex RICO, conspiracy, and communications law case.
- Secured a favorable settlement on behalf of a telecommunications company in a long-running dispute against a group of affiliated companies over fees charged as part of an access stimulation scheme in violation of RICO and California and Illinois state laws, and successfully defended against multiple breach of contract counterclaims.
