Benjamin advises on restructuring, insolvency, distressed debt and special situations – working with debtors, financial institutions, funds, insolvency practitioners and other stakeholders across the full spectrum of non-contentious and contentious matters both domestically and cross border.

Ben's experience spans financing arrangements, officeholder duties and safe harbour advice, workouts/turnarounds, liability management exercises, schemes of arrangement, receiverships, administrations, deeds of company arrangement, insolvency litigation, security enforcement and liquidations across a range of sectors.

  • Yuzhou Group Holdings on the restructuring of its USD6.7 billion offshore debt liabilities through parallel schemes of arrangement in the Cayman Islands and Hong Kong.*
  • Yestar Healthcare Holdings Company Limited on the restructuring of USD194.5 million in offshore bond liabilities through a scheme of arrangement in the Cayman Islands.*
  • An ad hoc committee of bondholders of USD senior notes issued by a British Virgin Islands subsidiary within a large Chinese real estate group in relation to recovery strategies and winding up proceedings.
  • Alvarez & Marsal as receivers in relation to the recognition and enforcement of a Singapore receivership order in the British Virgin Islands relating to certain obligor assets under an impaired USD200 million development finance facility.
  • KPMG as voluntary administrators and deed administrators on the successful recapitalisation of LJ Hooker Group entities.
  • Australian Unity on resolving an AUD128 million conspiracy claim arising in a litigation context.*
  • The Star Entertainment Group in relation to disclosure proceedings connected with an AUD350 million liquidated fund.*

Prior Experience

Prior to joining the firm, Ben was a senior associate in the restructuring practices of well-known law firms in both Australia and Hong Kong, and brings the added perspective of having worked in an institutional banking and credit restructuring role at a Big 4 Australian bank, where he managed distressed portfolios and worked collaboratively with internal and external advisors on complex workouts. This experience enables him to approach distressed situations with a commercial lens, informed by firsthand experience in credit risk, portfolio management and complex matters.
