Ciara Browne is an intellectual property and technology lawyer, with her work spanning both contentious and non-contentious intellectual property matters. She advises a wide range of indigenous and multinational clients on all aspects of intellectual property, including patent matters, trade marks, passing off, designs, copyright and database rights. Her practice takes a particular focus on multi-jurisdictional patent disputes and she deals with complex high value patent infringements and preliminary injunction applications before the Commercial Court.

Ciara is an Irish registered trade mark agent and European trade mark and design attorney.

Ciara also advises on complex intellectual property issues which arise in corporate transactions including mergers and acquisitions and company reorganisations.

EXPERIENCE

  • Acting for Merck Sharp & Dohme LLC before the Commercial Court in proceedings brought by Merck KGaA & Ors, alleging breach of contract, trade mark infringement and passing off arising from the use of “Merck”.
  • Acting for Merck Sharp & Dohme LLC before the Irish Supreme Court following the decision of the CJEU which was delivered on 19 December 2024. This decision restated the appropriate test for the grant of preliminary injunctions in Ireland.
  • Advising in relation to a number of life cycle management projects for various pharmaceutical companies some in respect of blockbuster products.
  • Advising Kephala Limited – a leading Irish Life Science Soonicorn in the infant health space - on a number of matters related to the protection and commercialisation of its key intellectual property.
  • Acting for a number of global pharmaceutical companies in relation to urgent preliminary injunction proceedings before the Irish Courts.
  • Acting for a software development company in complex Commercial Court proceedings relating to breach of confidence and involving highly contested discovery over which a narrow confidentiality club was imposed.*
  • Acting for a number of social media platforms on various Norwich Pharmacal Applications and take down requests.*
  • Advising a major sports organisation in relation to multiple copyright infringement claims.*
  • Acting for a well known Irish musician in relation to a copyright dispute involving a claim for joint authorship by another musician.*
  • Advising an Irish University in the defence of copyright infringement proceedings in the Circuit Court.*
