Euan is an experienced employment lawyer advising clients across a broad range of industries and sectors.

Euan is a trusted advisor for clients, providing practical and commercial advice on day-to-day employment issues which arise.  

Euan has experience in acting on behalf of clients in various contentious matters in the Employment Tribunal and Employment Appeal Tribunal.  He has also successfully acted for clients in both Scotland and England to obtain interim injunctions/interdicts in enforcing restrictive covenants.

As well as contentious work, Euan regularly advises clients on a range of projects for clients.  This includes negotiating contractual terms concerning TUPE, advising clients on the application of TUPE and supporting them with transfers in and out of their businesses; redundancy and restructuring of workforces; and drafting and negotiating settlement agreements.

EXPERIENCE

  • Acting on behalf of BEAR Scotland in relation to key Employment Tribunal and Employment Appeal Tribunal litigation regarding the proper calculation of holiday pay under the Working Time Regulations. 
  • Advising a client in the rail sector in relation to its industrial relations with multiple trade unions at sites across the UK. This included responding to voluntary and statutory recognition requests and supporting the client in respect of annual pay bargaining and the implications of the Supreme Court judgment in the Kostal case regarding circumvention of collective bargaining agreements. 
  • Supporting an international client in the Consumer Goods, Food and Retail Sector in relation to an internal investigation following multiple anonymous complaints of sexual harassment made against a senior manager through the company’s whistleblowing helpline.
  • Acting on behalf of a client in the Technology Sector regarding the enforcement of restrictive covenants against a group of current and former employees who sought to use confidential information belonging to the client to set up a competing business in breach of the restrictive covenant in their contracts. After successfully obtaining an interim interdict against the defendants, we were able to leverage the client’s bargaining position to obtain a favourable settlement which extended the period of restriction and prevented the defendants from setting up in competition for an extended period.
  • Representing an international provider of facilities management services in relation to various pieces of litigation, including a complex claim of constructive unfair dismissal, disability discrimination, unlawful deduction from wages and whistleblowing. The claim involved allegations spanning several years and was listed for an 8-day tribunal hearing but Euan represented the client in a judicial mediation session and was able to negotiate a resolution on behalf of the client.
  • Advising an Aviation Sector client in relation to the closure of its operations at a site, including collective redundancy consultation requirements and the potential application of TUPE to transfer services to replacement service providers.
