Charmaine's practice focuses on commercial litigation, acting for and assisting a range of major national and global insurers in relation to disputes throughout Australia and the Asia-Pacific region.

She regularly acts and advises clients on professional indemnity, transactional liability (warranty and indemnity), directors and officers, management liability, public liability risks and defamation.

She acts as defence counsel in litigation in the Superior Courts of Australia and the Federal Court of Australia on behalf of a broad range of professionals, across a range of industries and sectors, including financial services professionals, insurance brokers, barristers, construction professionals and allied health practitioners.

EXPERIENCE

  • Representing AXA XL, a global insurer, in a complex, multi party Directors & Officers indemnity dispute in the Supreme Court of New South Wales and the Court of Appeal.
  • Advising an insurer in relation to a coverage dispute with the policyholder concerning a buy-side warranty and indemnity claim valued in the hundreds of millions of dollars
  • Acting for Markel, the Directors & Officers insurer for five directors of a company, in the Federal Court of Australia Fair Work division proceedings commenced by the former CFO of the company as a whistleblower, alleging breach of statutory provisions.
  • Acting for Vero Insurance, the insurer of an aged care facility, in defence of proceedings brought by relatives of a deceased resident alleging psychological injury arising from the treatment of the resident.
  • Acting for various financial planners and insurance brokers in both litigated and non-litigated claims, advising in respect of complaints made against financial services licensees and credit licensees to the Australian Financial Complaints Authority.
  • Acting for a global teledentistry company and its associated orthodontists in defence of complaints made to Australian regulatory bodies such as the Health Care Complaints Commission, Office of Health Ombudsman Queensland and Australian Health Practitioner Regulation Agency, arising from allegations of negligence regarding the treatment provided to its customers.
  • Acting for barristers in complaints made to the Bar Association of New South Wales, including preparing submissions regarding professional misconduct.
  • Acting for London Underwriters and domestic insurers on indemnity disputes and providing general indemnity advice.
