Christopher Clark has experience in all manner of international trade-related matters, including U.S. export controls and economic sanctions, customs and trade remedy-related matters, and reviews before the Committee on Foreign Investment in the United States (CFIUS).

Chris focuses his practice on advising clients regarding complex compliance, licensing, and enforcement matters related to the Export Administration Regulations (“EAR”), International Traffic in Arms Regulations (“ITAR”), the economic sanctions administered by the Office of Foreign Assets Control (“OFAC”).  Chris has extensive experience assisting clients with understanding and navigating changes in the regulatory environment that impact their business.  Chris has advised clients in the aerospace and defense, semiconductor and advanced computing, telecommunications, energy, and other advanced technology sectors.

Chris routinely works with clients to design and implement compliance programs regarding U.S. export controls and economic sanctions.  Chris also has extensive experience in helping clients determine the export classification of their products and technologies and obtain any necessary export licenses.  Chris frequently assists clients with the preparation and submission of voluntary disclosures to the U.S. Department of Commerce and U.S. Department of State for possible export control violations.  Chris has considerable experience with conducting internal investigations and compliance assessments as part of the disclosure process.

Chris also has experience preparing and submitting CFIUS filings.  Chris leverages his export controls experience to assist U.S. companies with determining whether they have critical technologies that could require mandatory filings with CFIUS.  Chris also assists foreign investors with performing deal diligence on a U.S. business to identify possible critical technologies, as well as to assess the strength of the U.S. business’s compliance program.

Chris also has considerable experience counselling clients regarding compliance with U.S. customs laws, including antidumping (AD) and countervailing duties (CVD).  Chris has represented clients before the Court of International Trade and Court of Appeals for the Federal Circuit, challenging various AD/CVD scope rulings by the Department of Commerce, as well as decisions by U.S. Customs and Border Protections involving tariff classification and evasion determinations under CBP’s Enforce and Protect Act (EAPA) authorities.

EXPERIENCE

  • Advising companies, including those fabless design houses and companies that produce semiconductor manufacturing equipment, on compliance with U.S. export controls involving China and organizations on the Entity List.
  • Conducting numerous internal investigations and successfully resolving voluntary disclosures with BIS (EAR), DDTC (ITAR) and CBP (customs laws) for U.S. and non-U.S. companies across a broad range of sectors.
  • Developing and implementing compliance programs for several multinational companies, including topline policies and detailed procedures describing various aspects of the compliance programs, such as restricted party lists screening, export classification, and licensing determinations.
  • Evaluating export classification determinations for products, software and technology, and, where necessary or desirable, preparing and submitting export classification requests.
