Diego González has over 10 years of experience and focuses his practice on advising national and international companies on contractual and corporate labor matters, compliance and labor auditing processes, labor due diligence for the sale and merger of Chilean and foreign companies, collective bargaining procedures, advice on immigration matters for expatriates, and labor lawsuits.

EXPERIENCE

  • A regional construction company in its defense against a lawsuit brought by the director of a union federation alleging anti-union practices.
  • An important technology company operating in the retail industry in its defense in a crucial workforce trial in which an agent who provided services for more than five years was claiming the recognition of the labor relationship with the company. The trial was extremely relevant for the company and the stability of its business, as well as for the case law of the new law on digital platform employees. 
  • An important Chilean bank is investigating a claim of harassment at work by an employee against six co-workers in the context of years of an alleged complicated work environment. 
  • A retail holding company in a legal claim to reject fines that had been applied various times for the same infringement affecting different employees. The Court recognized that the company should not be fined more than once for the same violation, thereby annulling the fines. 
  • A company specializing in construction machinery maintenance in subcontracting lawsuits. The Labor Court of La Serena declared that there was no subcontracting regime and that the employee's responsibilities could not be extended to the company. 
  • A construction machinery maintenance company in its successful representation in a collective bargaining process with a company being acquired by the client. A favorable result was a precondition for the closing of the transaction. 
  • A leading mobilization application analyzing a service model involving contracts with driver groups that use its app to connect with users, including the labor implications under the Labor Code and the forthcoming Law on Platforms (Law 21.553). 
  • A port company in the retention of executives and key employees while closing the operations of the local company.
  • A company that produces industrial gases and medical oxygen in collective bargaining with its union.
  • An apparel retailer in a complex collective bargaining process for one of the industry's largest customers.
  • A company in the construction industry in a series of complex labor lawsuits.
  • An international insurance company in the purchase of the life insurance portfolio and shares of its fund manager, advising on the successful transfer of all employees of such entity.
