AssociateCherry Lai delivers strategic and commercially focused IP advice to multinational and regional clients across a broad range of industries.
She advises on the protection, exploitation, and enforcement of intellectual property rights, with particular experience in trademark, copyright, and technology-related matters. Her practice spans both contentious and non-contentious work, including global portfolio management, clearance, prosecution, oppositions, invalidations, non-use cancellations, customs recordation, online enforcement, and company name complaints.
Cherry also advises on intellectual property aspects of commercial and corporate transactions, including IP due diligence, ownership and licensing arrangements, and other intellectual property issues arising in M&A transactions. She regularly drafts and negotiates a range of commercial agreements, including licences, assignments, manufacturing agreements, tooling consignment agreements, franchise agreements, procurement contracts, and transitional services agreements.
In addition, she advises on advertising and consumer regulatory matters in Hong Kong, including product claims, prize promotions, marketing campaigns, and related compliance issues.

EXPERIENCE
- Managing a leading global fast-food company's trademark portfolio, dealing with new filings, renewals, assignments, oppositions, invalidations and enforcement across Asia.
- Advising on the IP issues relating to a partnership between two leading technology/media companies in the PRC relating to the delivery of a cloud computing solution in China. In the latest amendment, we advised on the restructure of a particular China-based CRM product and transfer of that; this involved close drafting and amendments to the complex original suite of documents to address various changes with updates to overall complex revenue sharing model, liability and IP assignments. The partnership included negotiation of a complex brand and trademark licence (including co-branding, marketing, and promotion across multiple territories) as well as IP licensing, technology transfer and employment issues (relating to high-value software and data).
- Advising Hillhouse Group, one of the largest and fastest-growing multi-national private equity and asset management firms, in protecting the goodwill, reputation, trade mark rights and other intangible rights in their house brands and trade names as well as their logos and a number of other brands, in Hong Kong, China, Singapore and several overseas jurisdictions.
- Advising Ping An on the trade mark prosecution before the Hong Kong Trade Marks Registry. We also advise Ping An on all aspects of brand protection and enforcement in Hong Kong, including company name infringement and the associated court proceedings in Hong Kong.
