Rafael is a Senior Associate in the Litigation and Regulatory group at DLA Piper’s Madrid office, specialising in competition law, telecommunications regulation, and EU law.

He has experience in all areas of competition law, having been involved in numerous merger control proceedings and infringement proceedings for cartels or abuses of dominant position before national and EU competition authorities, as well as representing clients in court proceedings before the National High Court and the Supreme Court.

He also regularly advises national and international telecommunications operators on competition law and all regulatory aspects related to their entry and establishment in the Spanish market, the deployment of their networks and their operations. Rafael participated in a secondment programme in the Competition and Regulation department of Vodafone Spain's Legal Department.

EXPERIENCE

Rafael's experience includes advising:

  • Vodafone on the acquisition of Spanish operator ONO.
  • Atlantia on its takeover bid for Abertis.
  • One of Spain's leading car manufacturers in proceedings brought by the CNMC in the sector (Case No. S/0482/13) and the subsequent legal proceedings.
  • On various merger control proceedings before the national and EU competition authorities for the formation of the largest Spanish healthcare group, as well as on its subsequent sale to a listed German company.
  • One of the world's largest media agencies in proceedings initiated by the CNMC in the sector (Case No. S/DC/0584/16) and subsequent legal proceedings.
  • Two major telecommunications operators in Spain in the investigation by the Spanish competition authority into their mobile and fixed network sharing agreements.
  • Several car manufacturers and multinational industrial groups on the creation and launch of their car sharing joint ventures in Madrid.
  • One of the leading international satellite operators on its entry into the Spanish market, as well as on the deployment of its fixed infrastructure and the development of its business.
  • A major British publishing group in the sanctioning proceedings brought by the CNMC against several textbook publishers (Case No. S/DC/0594/16) and the subsequent legal proceedings.
  • Vodafone and Orange on the deployment of 5G networks in Spain.
