Erin McLaughlin concentrates her practice on patent litigation, with an emphasis on Section 337 Investigations before the International Trade Commission (ITC). She has handled 15 ITC investigations and participated in 4 ITC trials. Erin has also represented clients in numerous matters in Federal District Court throughout the United States, including cases in Texas, California, and Delaware. She has experience in all phases of discovery, claim construction briefing, summary judgment briefing, pretrial and trial work.

Erin has a bioscience background and has experience representing clients in the automotive, software, consumer electronic device, and semiconductor industries.

Prior to joining DLA Piper, Erin was a law clerk and attorney for Charles E. Bullock, the Chief Administrative Law Judge at the U.S. International Trade Commission. She advised Chief Judge Bullock in 11 complex unfair import investigations, making recommendations regarding fact and expert discovery disputes, claim construction, patent infringement, validity, unenforceability, the domestic industry requirement, remedy and bonding.

EXPERIENCE

  • Certain RF Capable Integrated Circuits and Products Containing the Same (337-TA-982). Represented Respondent in ITC investigation involving RF modulation and demodulation technology. The case settled favorably for the client prior to trial
  • Certain Television Sets, Television Receivers, Television Tuners, and Components Thereof (337-TA-910). Represented multiple Respondents in ITC investigation involving silicon television tuner technology. Obtained an Initial Determination of No Violation of Section 337 from the ALJ, which was affirmed by the Commission after review
  • Certain Optical Disc Drives, Components Thereof, And Products Containing The Same (337-TA-897). Represented Respondent in ITC investigation regarding optical disc drive technology and related servo systems. Obtained two Initial Determinations from the ALJ finding no standing, which were upheld by the Commission after review
  • Certain Silicon Tuners And Products Containing Same, Including Television Tuners (337-TA-917). Represented Complainant in ITC investigation concerning silicon television tuner technology. Obtained a consent order from the lead respondent precluding importation of the accused products into the United States
