Aamir is an Associate in he Litigation, Arbitration and Investigations Group at DLA Piper and is based in Dubai. He has experience advising on various disputes including international arbitration and litigation.

Aamir’s clients include multinational companies, financial institutions, airlines and high net worth individuals.

EXPERIENCE

  • Shareholder dispute - Part of the team defending a USD150m claim against an audit firm by shareholders of a bank currently in liquidation. The shareholders allege that the client was negligent in providing a qualified opinion which resulted in the diminution of their share value. This is an important case touching on the proper plaintiff rule as well as the extent of an auditor's duty of care. *
  • Class action - Part of the team acting for a large audit firm in opposing the Plaintiffs' application seeking leave to file a class action suit, in a matter arising from a banking relationship between a bank and individual account holders. The matter also touched on the auditor's duty to the bank. It was important to prevent a class action suit being filed to limit the client's exposure particularly since there was no privity of contract between the client and the account holders. *
  • Breach of contract - Assisted in composite arbitral proceedings ( London Court of International Arbitration ) relating to breach of warranties of over USD 200m following an acquisition by a foreign entity of our client in Nairobi, Kenya. *
  • Breach of contract - Co- counsel in Chartered Institute of Arbitrators arbitration proceedings where we successfully mitigated a claim on behalf of a large electricity and power provider. The original claim was for over USD400m and we managed to reduce our client's the liability by 80%.*
  • Breach of contract - Co- counsel in Chartered Institute of Arbitrators arbitration proceedings where we successfully  defended a claim on behalf of the Government of Kenya in relation to a breach of contract worth USD11m for the installation of water transmission pipeline. *
  • Unfair termination - Successfully defended a large multinational company in a claim by 10 of its former employees seeking damages in the sum of USD1m for alleged unfair termination. The claim was dismissed in its entirely. *
  • Helicopter crash - Handling a claim for over USD48m following the death of three American passengers following a helicopter crash in Turkana country. *
  • International airline - I was a key member of the team handling the Ethiopian Airlines Flight ET-302 crash in relation to compensation for the families. *
  • Legislation - Co-counsel in challenging the constitutionality of amendments to the National Health Insurance Fund Act. The amendments sought to impose a back door tax on employers to fund the Government's Universal Health Care initiative. Successfully secured interim orders stopping the implementation of sections of the Act that affect employers in almost every industry. *
  • Creditor - Acted on behalf of an international airline in lodging an insolvency petition against another airline who was sub-contracted to undertake work on behalf our client but failed to remit monies collected. *
