EXPERIENCE

  • Advising taxpayer in ATO audit covering characterisation of payments (royalty withholding tax), permanent establishment issues (fixed place of business and / or substantial equipment) and Australia's anti-avoidance rules.
  • Advising one of the world's largest companies in relation to a historic global restructure under ATO review, as well as seeking to obtain a BAPA in parallel. Tax issues include transfer pricing, Australia's anti-avoidance rules, treaty shopping, withholding taxes and the diverted profits tax. 
  • Negotiating settlement of transfer pricing consequential adjustments with the ATO following litigation in the Federal Court of Australia. 
  • Assisting a funds client in re-establishing an effective working relationship with the ATO, including with early engagement discussions for multiple Australian transactions.*   
  • Assisting a multinational energy materials company with their ATO engagement strategy in advance of completing a significant transaction with an incoming strategic investor.*
